Planning & Zoning Commission/ <br />Local Planning Agency <br />November 10, 2010 <br />Page 6 <br />A brief discussion ensued regarding condition no. 4 regarding the hours for alcoholic beverage sales, In <br />response to the Commission's question, staff stated that the original variance granted by the City Commission for this <br />site on July 27, 2009 did not include an expiration date. <br />Mr. Parkhurst asked the applicant to come forward. Mr. Jim Wilson, 276 Fallen Palm Drive, Casselberry, <br />Florida came forward. In response to the Commission's question, Mr. Wilson said he had no objection to changing <br />the hours listed in condition number 4 to the hours regulated by Section 10-2 of the City Code. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address CU 10-08. Mr, Aramendia recommended approval of CU 10-08 <br />Brick and Fire and revising Condition no. 4 to read: The hours for sale of alcohol shall comply with Section 10-2 of <br />the City Code. Mr. Weinroth seconded the motion. The motion passed unanimously by voice vote. <br />Seventh Item of business: LPA 10.07: ULDR Amendments to Article VII, "General Regulations" Amendment <br />to fence and wall requirements to allow a maximum eight foot high fence or wall in residential and <br />commercial districts. <br />Ms. Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated November <br />10, 2010, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). Ms. Smith stated that the City Commission passed an ordinance allowing business <br />related vehicles to be parked in the side and rear yard if the vehicles are screened by an eight foot high fence and <br />recreational equipment must be screened by a fence, wall or healthy vegetation between six and eight feet in height. <br />She said currently the Unified Land Development Regulations (ULDR) allows a maximum fence/wall/ height of six <br />feet in residential and commercial districts; therefore an amendment to ULDR Section 2-7.9, Accessory Structure and <br />ULDR Section 2-7.10 Fences and Walls is required to reflect this change. <br />Ms. Smith requested the Planning and Zoning Commission provide a favorable recommendation to the City <br />Commission to amend the City of Casselberry Code of Ordinances, Part III, Unified Land Development Regulations, <br />Chapter II, District and General Regulations, Article VII, General Regulations, as provided in the draft ordinance <br />attached to the staff report. <br />
