All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void, <br />A general discussion ensued regarding condition number 4 limiting the hours the business is allowed to sell <br />alcoholic beverages. <br />Mr. Parkhurst asked the applicant to come forward, The Commission had no questions for the applicant. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address CU 10-07. Mr. Aramendia recommended approval of CU 10-07 <br />including staffs recommendations and revising Condition No. 4 to read: The hours for the sale of alcohol shall <br />comply with Section 10-2 of the City Code. Mr. Hale seconded the motion, The motion passed unanimously by <br />voice vote, <br />Sixth Item of Business: CU 10-08: Brick ~ Fire. Conditional use request to allow the consumption of <br />alcoholic beverages in conjunction with a restaurant operation in a CG zoning district. Property located at <br />1410 State Road 436, Casselberry, Florida. <br />Mr. Jason Sorensen, Planning Technician, reviewed the information provided in his memorandum dated <br />November 10, 2010, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). Mr. Sorensen said upon review of the conditional use request, the Planning and Zoning <br />Commission's approval of CU 10-08 to allow the on-site consumption of alcoholic beverages as allowed by the 2COP <br />state license, in conjunction with the operation of a restaurant located at 1410 State Road 436, would be based on <br />the findings of fact and conclusions of the staff report dated November 10, 2010, and the following conditions: <br />1. The conditional use shall be limited to the location of 1410 State Road 436, <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />3, Package sales of alcoholic beverages for off-site consumption are prohibited. <br />4. Hours of alcoholic beverage sales shall be Monday thru Friday, 11:00 a.m. to 10:00 p.m.; Saturday, <br />Noon -10:00 p.m.; and, Sunday, Noon - 9:00 p.m. <br />5. The business shall remain incomplete compliance with all City, County and State requirements. <br />6. There shall be no outside display or storage of goods, materials, services or vehicles. <br />7. The conditional use shall commence within 90 days of the approval. <br />8. The conditional use shall expire if the use is discontinued for more than 90 days. <br />9. All signage requires new permit approval and must comply with all city requirements. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />
