Planning & Zoning Commissionl <br />Local Planning Agency <br />November 10, 2010 <br />Page 2 <br />Ms. Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated November <br />3, 2010, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br />Development Department). Ms. Smith explained this item was advertised in the Orlando Sentinel on October 28, <br />2010 to provide a 180 day moratorium on approvals for the operation of cash only pharmacies, family medical <br />practices and pain management clinics. Ms. Smith stated since the time this item was advertised, the City <br />Commission has adopted Resolution No. 10-2199 to put legislation in progress that allows the City the ability to deny <br />approvals for these types of businesses. Ms. Smith explained that the resolution would be in effect until the City <br />Commission approves the moratorium for pain management type businesses. <br />Ms. Smith stated at this time the State of Florida does not have a prescription monitoring program. She said <br />prescriptions are being written for large quantities of pain management type drugs and the individuals are reselling <br />the pills. She explained that the State of Florida has adopted legislation to implement a prescription monitoring <br />program effective December 1, 2010; however, due to issues with the bidding process that program will be delayed, <br />She said once the program is in place it should substantially reduce these types of uses in the state. Ms. Smith <br />requested the Planning and Zoning Commission continue this item until the December 8, 2010 meeting to give staff <br />the opportunity to refine the definitions that are being used in the moratorium. Ms. Smith stated that the draft <br />moratorium ordinance provides an appeal process for a business that feels it does not meet the criteria in the <br />moratorium, <br />Mr. Parkhurst asked for a motion to address MISC 10-04. Mr. Aramendia made a motion to continue MISC <br />10-04 Pain Management to the December 8, 2010 Planning and Zoning Commission meeting. Mr, Weinroth <br />seconded the motion. The motion passed unanimously by voice vote. <br />Fourth Item of Business: SPR 1015: Monarch Plaza. A major site plan review for a new structure to be <br />constructed on the former Roadhouse Grill property located at 1870 State Road 436, Winter Park, Florida. <br />Mr. Eric Raasch, Planner I, reviewed the information provided in his memorandum dated November 5, 2010, <br />supported by a PowerPoint presentation, to the City of Casselberry Planning and Zoning Commission (a copy is on <br />file in the Community Development Department).
