Requests for Reduction of Code Enforcement Liens - 205 Colony Drive <br />Staff Presentation: Mr. Ketron Brown, Code Compliance Supervisor, stated consideration to reduce code <br />enforcement liens placed on property located at 205 Colony Drive for case numbers CE-09-03375 (swimming <br />pool/stagnant water) from $12,810 to $2,000 and CE-09-03376 (broken window) from $5,100 to $800 to be <br />paid within 60 days.. Two code enforcement violations occurred on the subject property in 2009 for a <br />swimming pool with stagnant water and a broken window. The properrty was in the process of foreclosure and <br />there was no contact from the property owners. These cases were presented at the November 5, 2009 Code <br />Enforcement Board meeting and at a subsequent hearing held on December 10, 2009, a $50 per day/per <br />violation fine was imposed. A third violation occurred on the subj ect propelrty in 2010 when the bank failed to <br />register the property with the City as required as an abandoned/foreclosed home. This case was presented on <br />April 8, 2010 to the Code Enforcement Board and at a subsequent meeting held on May 13, 2010 a fine of $50 <br />per day was imposed. On February 10, 2011, the Code Enforcement Board recommended a reduction of the <br />original two lien amounts for Case CE-09-03375 and CE-09-03376 based on the circumstances and foreclosure <br />issue. Although the property has since been registered with the City as required, the third case relating the <br />registration of the propelrty was denied a reduction of the lien amount of $2,300 and remains payable. <br />Recol•ding fees have been paid; other administrative costs are minimal and would be recoLiped as part of the <br />lien amount. The amended lien amounts must be paid within 60 days or the waiver becomes null and void. <br />Budget Impact: The lien amounts paid would be recognized in the City Budget as income received. <br />Recommendation: The City Manager requested consideration of the Code Enforcement Board's <br />recommendation to reduce the liens CE-09-03375 from $12,810 to $2,000 and CE-09-03376 from $5,100 to <br />$800, to be paid within 60 days. <br />MOTION: Commissioner Solomon moved to reduce the lien for case number CE-09-03375 <br />from $12,810 to $2,000, to be paid within 60 days or the lien fine amount <br />reverts back to the original amount. Motion was seconded by Commissioner <br />Doerner. Motion carried unanimously by voice vote 5 - 0. <br />MOTION: Commissioner Solomon moved to reduce the lien for case number CE-09-03376 <br />from $5,100 to $800, to be paid within 60 days or the lien fine amount reverts <br />back to the original amount. Motion was seconded by Commissioner Doerner. <br />Motion carried unanimously by voice vote 5 - 0. <br />13. CiTSI TE <br />A. Future Agenda Items <br />Commission consensus was to schedule a retreat without utilization of a facilitator and to place a discussion <br />item on the next meeting agenda to determine the date, location and tentative agenda. <br />Commissioner Solomon requested an evaluation be conducted for the City Attorney.
