<br />CASSELBERRY CITY COMMISSION <br />Minutes of October 26, 2009 - Regular Meeting <br />Page 9 of14 <br /> <br />accessories when parked on the side and screened. <br />-Rear screening required for all properties and limiting the number of vehicles. <br /> <br />Further discussion ensued how best to incorporate the changes and move forward <br />with finalizing all the parking regulations. <br /> <br />AMENDED MOTION: <br /> <br />Commissioner Miller moved to approve Ordinance 09-1306 on <br />first reading as amended by incorporating the Planning and <br />Zoning Commission's recommendation regarding fence <br />material and construction of 8 ft. fences, and to eliminate <br />language references to factory engineered racks. Motion was <br />seconded by Commissioner Solomon. Motion failed 2 - 3 <br />(Commissioner Doerner, Vice Mayor Hufford and Mayor <br />Glancy dissenting) by voice vote. This ordinance was denied on <br />first reading. <br /> <br />Commission consensus was to direct staff to draft a new ordinance to address the inconsistencies with <br />the parking ordinances for different vehicles and recreational equipment. It was requested that a <br />workshop be held prior to the December 14, 2009 City Commission meeting to discuss the new draft <br />ordinance. <br /> <br />MOTION: <br /> <br />Commissioner Solomon moved to continue the meeting and address the <br />remaining items on the agenda. Motion was seconded by Commissioner Miller. <br />Motion carried unanimously by voice vote 5 - O. <br /> <br />Mayor Glancy declared a recess at 9:41 p.m. The meeting was reconvened at 9:48 p.m. <br /> <br />11. RESOLUTIONS <br /> <br />A. Resolution 09-2088 - Rental Property Business Tax <br /> <br />The City Clerk read Resolution 09-2088 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING THE <br />IMPOSITION OF A BUSINESS TAX FOR RESIDENTIAL RENTAL PROPERTIES AS PROVIDED <br />WITHIN THE TAX SCHEDULE OF THE CASSELBERRY CITY CODE, SECTION 26, <br />BUSINESSES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Resolution 09-2088 provides for imposition ofa <br />business tax for residential rental properties as provided within the tax schedule of City Code Section 26, <br />Businesses. The Resolution also clarifies the need for a commercial property owner to obtain a business tax <br />receipt for commercial properties without a leasing office on-site. The primary reason the City Commission <br />desired to implement this program was to ensure that there were contact names and numbers for rental <br />propeliies located in the City relating to property maintenance issues.
