<br />CASSELBERRY CITY COMMISSION <br />Minutes of October 26, 2009 - Regular Meeting <br />Page 8 of14 <br /> <br />. The height of an existing fence shall not be increased by the attachment of materials that are <br />different than the existing fence material. The fence shall provide an appearance that is a <br />uniform design and harmonious with the site. <br />. Vehicles parked in the side yard of a property adj acent to a lake shall additionally be screened <br />from the view of that lake. <br /> <br />City staff recommended consistency for all properties by either providing the rear screening for all properties or <br />none. The number of parking variables provided within ULDR Section 3-10.9 creates a plethora of parking <br />scenarios that are unwieldy and staff was concerned that it will be very difficult to educate the public as to their <br />parking options as well as being difficult to enforce. <br /> <br />Budget Impact: This ordinance has no impact on the City's budget. <br /> <br />Audience Participation: The following individuals address Ordinance 09-1306: <br /> <br />1) Mr. Craig Tull, 420 Ranch Trail, spoke in opposition to Ordinance 09-1306. <br /> <br />2) Ms. Diane Nease, 402 Gregory Drive, spoke in opposition to Ordinance 09-1306. <br /> <br />3) Mr. James Fraleigh, 1290 Seminola Boulevard, spoke in opposition to Ordinance 09-1306. <br /> <br />4) Mr. John Casselberry, 700 South Lost Lake Lane, spoke in opposition to Ordinance 09-1306. <br /> <br />MOTION: <br /> <br />Vice Mayor Hufford moved to approve Ordinance 09-1306 on first reading, as <br />presented. Motion was seconded by Commissioner Miller. <br /> <br />DISCUSSION: Commissioner Miller and Vice Mayor Hufford stated they were in favor of adding <br />the Planning and Zoning Commission's recommendation regarding fence material <br />and construction of 8 ft. fences. Commissioner Solomon spoke in support of <br />Ordinance 09-1306. Vice Mayor Hufford stated she was in favor of adding the <br />Planning and Zoning Commission's recommendation regarding additional screening <br />for the rear yard when vehicles with attachments and accessories are parked in a side <br />yard of a lakefront property. Mayor Glancy voiced concerns regarding the <br />inconsistencies with the parking ordinances between the different types of vehicles <br />and recreational equipment, as well as the language regarding factory engineered <br />racks since that is not regulated by any other entity. Commissioner Doerner voiced <br />concerns regarding the inconsistencies with the parking ordinances between the <br />different types of vehicles and recreational equipment. Discussion ensued regarding <br />parking in the backyard and recreational vehicles in general. <br /> <br />Consensus was reached on the following: <br /> <br />-Eliminate the factory engineered racks language and insert language stating the <br />attachment could not go past the front window or past the rear bumper would provide <br />the desired intent. <br />-Add the Planning and Zoning Commission's recommendation regarding fence <br />material and construction of 8 ft. fences. <br />-Removal of accessories only when parked in the driveway; not necessary to remove <br />
