Approval to Submit Application for Seminole County Boating Improvement Program <br />Grant <br /> <br />Introduction: This agenda item requests approval to submit an application to Seminole County for the <br />Boating Improvement Program Grant. The City is seeking to continue the geo tubing around to the <br />southwestern short of North Lake Triplet to reach the boat launch site. This will further stabilize and prevent <br />additional erosion to this portion of the shoreline. <br /> <br />Budget Impact: There is no budget impact. Notification of the award will occur at the end of February, and <br />if awarded, the grant will require the City to pay the expenses up front and be reimbursed upon completion. <br />No City match is required for this grant. <br /> <br />Recommendation: The City Manager and the Administrative Services Director recommended approval to <br />submit the application for the Seminole County Boating Improvement Program Grant. <br /> <br />MOTION: <br /> <br />Commissioner Miller moved to approve the Consent <br />Agenda as presented. Motion was seconded by Vice <br />Mayor Hufford. Motion carried unanimously by voice <br />vote 5 - O. <br /> <br />9. PUBLIC HEARINGS <br /> <br />No items were scheduled on this agenda. <br /> <br />10. FIRST READING OF ORDINANCES <br /> <br />A. First Reading of Ordinance 09-1273 - Nuisance Abatement <br /> <br />The City Clerk read Ordinance 09-1273 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA AMENDING <br />SECTION 70-2, PROPERTY MAINTENANCE, OF CHAPTER 70, SOLID WASTE, OF <br />THE CODE OF ORDINANCES TO INCLUDE TALL GRASS AS A NUISANCE, AND <br />TO INCLUDE PROCEDURES FOR ABA TEMENT OF NUISANCES; PROVIDING FOR <br />SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Police Chief Jim Ruf stated Ordinance 09-1273 provides clear and concise direction to <br />the identification of certain public nuisances. In addition, the changes will provide the ability to <br />administratively abate those nuisances at the expense of the property owner, as opposed to judicial authority <br />from the Code Enforcement Board. The Code Enforcement Board currently only has the authority to abate <br />a nuisance or hazard under Florida Statutes when a serious hazard exists. Ordinance 09-1273 proposes that <br />the Code Enforcement Board members would also serve in the capacity ofthe Nuisance Abatement Board. <br />
