CASSI;LBI;RRY CITY COMMISSION <br />Minutes of January 10, 2011-Regular Meeting <br />Page 9 of 21 <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 10-1343 provides for requiring an <br />eight (8) foot high screen for business related vehicles, and requiring a six (6) foot to eight (8) foot high screen <br />for recreational eglipment.. The City Commission approved Ordinance 10-1343 on first reading on December <br />13, 2010, inchlding the Planning and Zoning Commission's recommendation to eliminate the 35-foot <br />maximum length requirement on recreational vehicles. The City Commission also took an additional vote to <br />postpone enforcement of the screening requirement for recreational equipment until February 1, 2012. It was <br />further noted that upon adoption, a six month public education period will be in effect until enforcement begins <br />August 1, 2011 for all other residential parking changes effectuated by this ordinance and Ordinance 10-1314. <br />Budget Impact: This item has no impact to the City Budget. <br />Recommendation: The City Manager and the CommunitybevelopmentDhector recommended approval of <br />Ordinance 10-1343 on second and final reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 10-1343. The following <br />individual came forward: <br />1.) Mr. David Henson, 233 Bridle Path, spoke in favor of Ordinance 10-1343. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 10-1343. <br />MOTION: Vice Mayol• Miller moved to approve Ordinance 10-1343 on second reading, as <br />presented. Motion was seconded by Commissioner Solomon. Motion carried <br />unanimously by voice vote 5 - 0. <br />C. First Reading of Ordinance 11-1344 - Moratorium on Pain Management Clinics and <br />Cash Only Pharmacies (MISC 10-04~ - <br />The City Clerk read Ordinance 11-1344 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, PERTAINING TO "CASH <br />ONLY PHARMACIES" AND "PAIN MANAGEMENT CLINICS", IMPOSING A TEMPORARY <br />MORATORIUM ON THE ISSUANCE OF DEVELOPMENT PERMITS AND BUSINESS TAX <br />RECEIPTS FOR THE OPERATION OF "CASH ONLY PHARMACIES" AND "PAIN <br />MANAGEMENT CLINICS" IN THE CITY OF CASSELBERRY FOR PERIOD OF ONE YEAR (365) <br />DAYS; SETTING FORTH FINDINGS, PURPOSE, AND DECLARATION; PROVIDING FOR <br />DEFINITIONS OF "CASH ONLY PHARMACIES" AND "PAIN MANAGMEMENT CLINICS"; <br />PROVIDING FOR EXEMPTIONS; PROVIDING NOTICE WAIVED; PROVIDING A SUNSET <br />PROVISION; PROVIDING FOR SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 11-1344 was published in the <br />Orlando Sentinel on December 30, 2010. <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 11-1344 imposes a one year <br />moratorium on the issuance of business tax receipts, permits, development orders or any other official action <br />
