CASSELBI'JRRY CITY COMMISSION <br />Minutes of January 10, 2011- Regular Meeting <br />Page 10 of 21 <br />related to "cash onlypharmacies" and "pain management clinics" within the City limits. The moratorium will <br />provide staff with an opportunity to work with other jurisdictions to study the issue comprehensively and <br />determine appropriate requirements to regulate these uses. Additionally, the one year moratorium may give the <br />State sufficient time to set up their required Prescription Drug Monitoring (PDMP) program. <br />Budget Impact: This item has no impact on the City Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 11-1344 on first reading. <br />Public Hearing: Mayor Glancy opened the public hearing relative to Ordinance 11-1344. The following <br />individual came forward: <br />1.) Mr. John Casselberry, 700 South Lost Lake Lane, voiced concerns about the ordinance if it <br />places a moratorium on urgent care facilities such as a Centra Care opening. <br />No one. else came forward. Mayor Glancy closed the public hearing relative to Ordinance 11-1344. <br />MOTION: Commissioner Hufford moved to approve Ordinance 11-1344 on first reading, <br />as presented. Motion was seconded by Commissioner Solomon. <br />DISCUSSION: The City Attorney suggested eliminating "or major credit card" from the definition of <br />Cash Only Pharmacies located in Section 3 of Ordinance 11-1344. The Commission <br />agreed to the modification of the definition of Cash Only Pharmacies. <br />AMENDED MOTION: Commissioner Hufford moved to approve Ordinance 11-1344 on first <br />reading, as amended. Motion was seconded by Commissioner Solomon. <br />Motion carried unanimously by voice vote 5 - 0. <br />D. First Reading of Ordinance 11-1345 -Amendment to ULDR Section 3-14.8, Tree <br />Replacement Reduirements <br />The City Cleric read Ordinance 11-1345 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY CODE OF ORDINANCES, PART III, UNII'IED LAND DEVELOPMENT <br />REGULATIONS, SECTION 3-14.8, "REPLACEMENT REQUIREMENTS" OF ARTICLE XIV, <br />"TREE PROTECTION", CHAPTER IH, "PERFORMANCE CRITERIA", TO INCLUDE DEAD <br />TREES ON UNDEVELOPED COMMERCIAL PROPERTIES, EXCLUDING TREES THAT HAVE <br />BEEN INTENTIONALLY DAMAGED; PROVIDING FOR SEVERABILITY, CODIFICATION, <br />CONFLICTS, AND EFFECTIVE DATE." <br />Staff Presentation: Mr•. Eric Raasch, Planner, requested the first reading of Ordinance 11-1345 be continued <br />in order for the required notice of public hearing to be advertised. <br />
