First Reading of Ordinance 10-1321 -North Winter Park Drive Future Land Use Map Amendments The City Clerk read Ordinance 10-1321 by title as follows; "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF CASSELBERRY'S COMPREHENSIVE PLAN BY AMENDING THE OFFICIAL LAND USE MAP (FLUM) TO INCLUDE PROPERTIES ANNEXED INTO THE CITY OF CASSELBERRY; AMENDING THE FUTURE LAND USE OF PROPERTIES DESIGNATED BY THE "NORTH WINTER PARK DRIVE (BETWEEN SR 434 AND 7TH STREET) STUDY"; AMENDING TEXT WITHIN THE FUTURE LAND USE ELEMENT POLICY FLU 110; PROVIDING FOR TRANSMITTAL OF THE PLAN AMENDMENTS TO THE DEPARTMENT OF COMMUNITY AFFAIRS; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTNE DATE." Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 10-1321 was published in the Orlando Sentinel on March 11, 2010. Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 10-1321 provides for amendments to the Future Land Use Map (FLUM) and Future Land Use Element (FLUE) text to address the strategies provided in the North Winter Park Drive Study (between State Road 434 and 7t'' Street) conducted by Kimley Horn and Associates. Ml•. Tim Stillings of Kimley Horn and Associates, gave a presentation regarding the North Winter Park Study, which is attached to and made a part of these minutes. The Planning and Zoning Commission gave a favorable recommendation to the City Commission on the proposed amendments at its February 24, 2010 meeting. Ms. Smith noted if approved on first reading, Ordinance 10-1321 will be transmitted to the Department of Community Affairs (DCA) for their Objections, Recommendations, and Comments (ORC) review. Upon satisfaction of DCA's review comments, the ordinance will be returned to the City Commission for a second reading and public hearing. Budget Impact: This item does not impact the City's Budget. Recommendation: The City Manager and the Community Development Director recommended approval of Ordinance 10-1321 on first reading. Public Hearing: A sign-in sheet was provided for anyone wishing to receive information updates regarding the DCA review. The following individuals came far•ward to address Ordinance 10-1321; 1) Mr. James Fraleigh, 1290 Seminola Boulevard, spoke in opposition to Ordinance 10-1321 and voiced concerns regarding representation of the citizens by the City Commission through their actions. Mayor Glancy ordered Mr. Fraleigh to leave the meeting due to disruptive conduct. No one else came fol•ward to address Ordinance 10-1321. Mayor Glancy closed the public hearing relative to Ordinance 10-1321. MOTION: Vice Mayor Solomon moved to approve Ordinance 10-1321 on first reading, as presented. Motion was seconded by Commissioner Hufford. Motion carried unanimously by voice vote 5 - 0.
