Chris Roper, Attorney with Akerman Senterfitt, 420 South Orange Avenue, Suite 1200, Orlando, <br />stated he was representing his client Southern Management which owns a 10 acre parcel located on <br />State Road 436 near Red Bug Lake Road. Ml•. Roper spoke in favor of Ordinance 10-1324. Mr. <br />Roper clarified that the language proposed in Ordinance 10-1324 was from a similar ordinance <br />adopted by Seminole County in 2008 and stated he would provide a copy of that information to the <br />City Attorney. <br />No one else came forward to address Ordinance 10-1324. Mayor Glancy closed the public hearing relative to <br />Ordinance 10-1324. <br />MOTION: Commissioner Hufford moved to approve Ordinance 10-1324 on first reading, <br />as presented. Motion was seconded by Vice Mayor Solomon. Motion carried <br />unanimously by voice vote 5 - 0. <br />F. First Reading of Ordinance 10-1325 - SR 436 Future Land Use Map Amendments <br />Due to City-Wide Historical "Errors & Inconsistencies" (LPA 09-15) <br />The City Clerk read Ordinance 10-1325 by title as follows: <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE CITY OF <br />CASSELBERRY'S COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL FUTURE LAND <br />USE MAP DESIGNATION OF CERTAIN PROPERTIES THROUGHOUT THE CITY TO PROVIDE <br />THE CORRECT DESIGNATION DUE TO PREVIOUS MAPPING ERRORS; AMENDING THE <br />FUTURE LAND USE MAP TO INCLUDE THE ANNEXATION OF LAKE KATHRYN ESTATES <br />MOBILE HOME PARK; PROVIDING FOR TRANSMITTAL OF THE PLAN AMENDMENT TO <br />THE DEPARTMENT OF COMMUNITY AFFAIl2S; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 10-1325 was published in the <br />Orlando Sentinel on March 11, 2010. <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 10-1325 provides for amendments to <br />the Future Land Use Map (FLUM) for twelve (12) properties within the City in older to correct various <br />historical enrols and map inconsistencies. Twenty-eight (28) properties were presented to the Planning and <br />Zoning Commmission and were separated into three distinct groups in the staffreport as 1) Historical Errors, 2) <br />Lake Kathryn Estates, and 3) Office Residential Corrections. The Planning and Zoning Commission <br />recommended approval of the proposed amendments at its March 10, 2010 meeting, including the removal of <br />properties due to owner's opposition within the Office Residential group from the proposed amendments and <br />Parcel 10-21-30-501-0000-35B0 was removed from the Historical Errors group since the parcel currently <br />services as a retention area, which is consistent with the existing Public Service FLUM designation. Ms. Smith <br />noted if approved on first reading, Ordinance 10-1325 will be transmitted to the Department of Community <br />Affairs (DCA) for their Objections, Recommendations, and Comments (ORC) review. Upon satisfaction of <br />DCA's review comments, the ordinance will be returnred to the City Commission for a second reading and <br />public hearing. <br />
