MOTION: David Henson moved to find Respondent(s) in CEB Case #10-02058, 10-02129, 10-02131, 10- 02158, 10-02268 was/were in violation of City Code, Section 70-2(C) or ULDR Section 3-10.9 (A)(4) and failed to correct the violation by the time specified for correction by the Code Enforcement Officer; that the violation is now corrected; and that any violation of the same code by Respondent(s) within FIVE (5) years from the date of this Order shall be treated as a repeat violation, for which a fine of up to $500.00 per day may be imposed. Kathleen A. Hale seconded the motion. The motion passed unanimously. ® Property located at 815 Osceola Trail: CE-10-02067 Property maintenance/stagnant water 70-2 (C) CE-1 D-02068 Overgrown property 70-2 (C) Marlene Broman, Code Compliance Officer gave testimony for the above cases. The City asked for a compliance date of 11/19/2010 and a $50.00 per day fine if no compliance. MOTION: Paul L. McKernan moved to find Respondent(s) in CEB Case #10-02067 and 10-02068 in violation of City Code, Section 70-2(C), and that Respondent(s) coi7ect the violation before 1:00 p.m. 11/18/2010. Another hearing will be held before this Board on 12/09/2010 to determine compliance by the aforestated date, and, if there is no compliance by the aforestated date, a fine in the amount of $50.00 per violation per day will be imposed for each and every day the violation continues past the aforestated date.
