MOTION: Kathleen A. Hale moved that the Board recommend to the City Commission that the lien will be <br />reduced in CEB Case #08-02342, #OS-03533, #09-03416, and #10-00004 from $16,930 to $8,500, to be paid <br />within 120 days from the date of the Commission's Order, or the fine reverts to the original fine amount. The <br />reasons for this reduction are: The gravity of the violation, the time it tools to come into compliance, accrued <br />amount of the lien, and any other mitigating circumstances. Nole Smith seconded the motion. The City asked for <br />a compliance date of 11/22/2010 and a $50.00 per day fine if no compliance. <br />Morgan Swite, Law offices of Marshall Watson, gave testimony for CEB case # 10-02092 and 10-02119. <br />MOTION: David Henson moved to find Respondent(s) in CEB Case #10-02079, 10-02081, 10-02092, 10- <br />02096, 10-02098, 10-02102, 10-02114, 10-02119, 10-02132 in violation of City Code, Section Art VI <br />Chapter 58 Sec 6(a), and that Respondent(s) correct the violation before 1:00 p.m., 11/18/2010. Another <br />hearing will be held before this Board on 12/09/2010 to determine compliance by the aforestated date, and, if <br />there is no compliance by the aforestated date, a fine in the amount of $50.00 per day will be imposed for <br />each and every day the violation continues past the aforestated date. The Respondent(s) is/are further ordered <br />to contact the Code Inspector to verify compliance with this Order. Kathleen A.
