"(e) If the property is not connected within aone-year period, the City <br />shall automatically levy a minimum monthly sewer charge on the owner, <br />occupant or tenant of the property." <br />SECTION III. That a new Section 86-30 (f) is hereby added to the City Code of the <br />City of Casselberry, Florida, to read as follows: <br />"(f) The minimum monthly sewer charge above is hereby known as the <br />Flow-by Availability Charge. Following the end of the one year period <br />above, the Flow-by Availa'ility Charge shall be equal to the Minimum <br />Monthly Charge(s) shown in Sec. 86-72 for the specific User Category(s) <br />of the property. In the event that the property is connected to the City <br />sewer in the future, one hundred percent (100%) of the Flow-by <br />Availability Charge paid by the Applicant or current account holder, shall <br />be credited against the Sewer Benefit Fee." <br />SECTION IV. That Section 86-31(c)(2) of the City Code of the City of Casselberry, <br />Florida, is hereby amended to add a new sentence after the first sentence to read as follows: <br />"This provision does not exempt the property owner, occupant, or tenant <br />from the required payment of the Flow-by Availability Charge per Sec. 86- <br />30(f)." <br />SECTION V. That Section 86-32(a) of the City Code of the City of Casselberry, Florida, <br />is hereby amended to change the first sentence to read as follows: <br />"(a) Any sewer extension outside the corporate limits of the City in excess <br />of three hundred (300) lineal feet must be approved by the City <br />Commission." <br />SECTION VI. That Paragraph 86-68(d) of the City Code of the City of Casselberry, <br />Florida, is hereby amended to read as follows: <br />"(d) Septic tank exception. All properties in the service area which are <br />served by septic tank service on the effective date of this ordinance, shall <br />retain the privilege to pay the one time charge per sewer unit served of <br />$350.00 per ERU (in-City) or $437.00 per ERU (outside-City) at any time <br />within one year from the date that sewer service is available at the site as <br />verified and recorded in the office of the City Department of Public <br />Works. All affected property owners will be notified when sewer becomes <br />available and as to the date of beginning of the one year period. Those <br />exercising this privilege shall pay regular sewer availability charges and <br />commodity charges upon the next regular billing cycle after application, <br />and thereafter. <br />2 <br />
