ORDINANCE 94-799 <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING CHAPTER 86, ARTICLE II, SEWERS, OF THE CITY <br />CODE OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING <br />FOR THE DEFINITION OF FLOW-BY AVAILABILITY CHARGE; <br />PROVIDING FOR THE ESTABLISHMENT OF, APPLICATION <br />AND CREDIT FOR FLOW-BY AVAILABILITY CHARGES; <br />REVISING THE APPROVING AUTHORITY FOR SEWER <br />EXTENSION; REVISING THE SEPTIC TANK EXCEPTION, <br />REVISING THE ADDITIONAL COSTS TO BE PAID BY THE <br />CUSTOMER FOR SEWER EXTENSIONS, PROVIDING FOR <br />RECOVERY OF CAPACITY; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the City of Casselberry adopted a Comprehensive Plan; and <br />WHEREAS, the sanitary sewer element of the Comprehensive Plan encourages the <br />elimination of septic systems; and <br />WHEREAS, the City of Casselberry wishes to develop policies and procedures to <br />implement elimination of septic tank systems; and <br />WHEREAS, these policies and procedures will be environmentally sound and <br />economically feasible. <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF <br />THE CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br />SECTION I. That Section 86-26, Definitions, of the City Code of the City of <br />Casselberry, Florida, is hereby amended to add the definition of Flow-by Availability Charge to <br />read as follows: <br />"Flow-by Availability Charge means a minimum monthly charge imposed <br />on an owner, resident or tenant of a property not connected to the City <br />Sewer System but which property has City sewer within 100 feet of the <br />property and who has had one year in which to connect but has not. The <br />Flow-by Availability Charge is the cost to the City to provide the <br />capability to provide sewer collection, treatment, and disposal capacity to <br />the property." <br />SECTION II. That Section 86-30 (e) of the City Code of the City of Casselberry, <br />Florida, is hereby amended to add a new sentence after the last line to read as follows: <br />1 <br />
