Planning & Zoning Commission/ <br />Local Planning Agency <br />September 8, 2010 <br />Page 3 <br />Fourth Item of Business: LPA 10.04: Internet Cafe/Sweepstakes Redemption Amending the City of <br />Casselberry Code of ®rdinances, Part III, Unified Land Development Regulations, to designate game rooms, <br />arcades, internet cafes, sweepstakes redemption centers and similar indoor entertainment and amusement <br />activities" as a "non•traditionaluce". <br />Ms. Sandra Smith, Chief Planner, reviewed the information provided in her memorandum dated September <br />8, 2010, to the,City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Ms. Smith stated upon advisement by the City Attorney, staff is withdrawing this item from consideration <br />and instead requesting the Planning and Zoning Commission to recommend an additional ninety day extension to the <br />moratorium that would then expire on February 5, 2011. The request is based on the following considerations: <br />o The City of Longwood's lawsuit is on-going. <br />o Seminole County is considering an ordinance to implement legislation, which may include the municipalities, <br />to prohibit the aforementioned uses. <br />o After the November general election a new Attorney General will be seated. The current Attorney General <br />and the Statewide Prosecutor have been unwilling to address the status of these uses. Perhaps the new <br />Attorney General will require this issue to be pursued by the Statewide Prosecutor or make a determination <br />of his own regarding the uses. <br />o Generally, a moratorium is applied for one year. Seeking an additional ninety days will result in a full one <br />year moratorium on the internet cafe, sweepstake redemption type uses, <br />Ms. Smith requested the Planning and Zoning Commission to provide a favorable recommendation to the City <br />Commission to extend the moratorium related to game rooms, arcades, internet cafes, sweepstakes redemption <br />centers, and similar indoor entertainment and amusement activities for an additional ninety days, to expire February <br />5, 2011. <br />After a brief discussion regarding the length of the extension, Mr. Parkhurst asked if there was anyone in the <br />audience who wished to speak in favor of, or in opposition to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address LPA 10-04. Mr. Aramendia made a motion to provide a <br />favorable recommendation for LPA 10-04 Internet Cafe to the City Commission based on the staff report dated <br />September 8, 2010 from Ms, Smith to the Planning and Zoning Commission as presented. Mr. Bal<alla seconded the <br />motion. The motion passed unanimously by voice vote. <br />Fifth Item of Business: ZB 10.02 Rezoning of City Center and Concord Center Property, Rezoning City <br />Center properties from PMX•W (Planned Mixed Use -High Intensity Non-residential) and the Concord Center <br />properties from CG (Commercial General) to PMX•Mid (Planned Mixed Use Medium•Rise). <br />
