Planning & Zoning Commission/ <br />Local Planning Agency <br />September 8, 2010 <br />Page 2 <br />request to extend the site plan approvals for SPR 06-28 (master site plan) and SPR 07-13 (Walmart site plan) from <br />October 8, 2010 to October 8, 2011. The Planning and Zoning Commission's recommendation of approval to the <br />City Commission for SPR 10-13, an extension to the approved master site plan (SPR 06-28) and the Walmart site <br />plan (SPR 07-13) for the properties located at 5655 US Highway 17-92, would be based on the staff report dated <br />September 8, 2010, the finding of fact, and the conditions listed in the staff report which were; <br />1. The Casselberry Exchange Master Site Plan modification (SPR 06-28) as approved by the City <br />Commission on October 8, 2007, including the site plan dated August 22, 2007 and all general notes in <br />the site plan package and conditions of approval shall be upheld by the owner and their successors or <br />assigns. <br />2. The Walmart site plan (SPR 07-13) as approved by the City Commission on October 8, 2007, including <br />the site plan dated August 22, 2007 and all general notes in the site plan package, the site development <br />agreement, and the conditions of approval shall be upheld by the owner and their successors or <br />assigns, unless a new site plan is approved for the property. <br />3. Both site plan approvals shall be valid for an additional year and shall be extended to October 8, 2011. <br />If deemed necessary, an additional extension request must be submitted prior to the expiration. <br />4. No construction shall begin prior to the issuance of site engineering permits by the City's Public Works <br />Department. <br />In response to the Commission's question, Ms. Smith stated that the City's Code allows a one year <br />extension for site plans and the applicant may be required to request an additional extension based on the <br />anticipated construction dates. Ms. Smith explained that Senate Bill 360 indicated that a two year extension should <br />be allowed for all site plan approvals; however that legislation has been overturned. Ms. Smith stated that the City <br />reviewed all site plan extensions on a case by case basis based on the City Code and not Senate Bill 360. <br />Mr. Parkhurst asked the applicant to come forward. Mr. Lee Mullon, Cochrane, 201 South Bumby Avenue, <br />Orlando, Florida came forward. Mr. Mullon said he agrees with staffs recommendation and is available to answer <br />any questions. The Commission had no questions for the applicant. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address SPR 10-13. Mr. Aramendia provided a favorable <br />recommendation of SPR 10-13 to the City Commission based on the staff report dated September 8, 2010 from Ms. <br />Smith to the Planning and Zoning Commission as presented. Mr. Bakalla seconded the motion. The motion passed <br />unanimously by voice vote. <br />
