The motion <br />passed unanimously by voice vote. <br />Fourth Item of Business: CU 1006: New Pekin Buffet Conditional use request to serve alcohol in a CG <br />zoned district. Property located at 100 Live ®aks Boulevard. <br />Mr. Eric Raasch, Planner I, reviewed the information provided in his memorandum dated August 20, 2010, <br />supported by a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy is on <br />file in the Community Development Department). Mr. Raasch said upon review of the conditional use request, the <br />Planning and Zoning Commission's approval of CU 10-06 to allow the on-site consumption of alcoholic beverages as <br />allowed by the 2COP SRX state license, in conjunction with the operation of a restaurant located at 100 Live Oaks <br />Boulevard would be based on the findings of fact and conclusions of the staff report dated August 20, 2010, and the <br />following conditions: <br />1. The conditional use shall be limited to the location of 100 Live Oaks Boulevard. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />3. Package sales of alcoholic beverages for off-site consumption are prohibited. <br />4. Hours of alcoholic beverage sales shall be Monday thru Sunday, 11:00 p:-r~: a.m, to 10:30 a+~: p.m. <br />5. The business shall remain in complete compliance with all City, County and State requirements, <br />6. There shall be no outside display or storage of goods, materials, services or vehicles. <br />7. The conditional use shall commence within 90 days of the approval. <br />8. The conditional use shall expire if the use is discontinued for more than 90 days. <br />9. All signage requires new permit approval and must comply with all city requirements. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Parkhurst asked the applicant to come forward. The applicant was not present at the meeting. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address CU 10-06. Mr. Aramendia recommended approval of CU 10-06 <br />Casselberry New Peking Buffet correcting condition number 4 in the staff report to read: "Hours of alcoholic beverage <br />sales shall be Monday thru Sunday 11:00 a.m. to 10:30 p.m. and based on the staff report dated August 20, 2010 <br />from Mr. Raasch to the Planning and Zoning Commission as presented. Mr. Van Meter seconded the motion. The <br />motion passed unanimously by voice vote. <br />Fifth Item of Business: ®ther Business. <br />
