The motion passed unanimously by voice vote. Fourth Item of Business: CU 1006: New Pekin Buffet Conditional use request to serve alcohol in a CG zoned district. Property located at 100 Live ®aks Boulevard. Mr. Eric Raasch, Planner I, reviewed the information provided in his memorandum dated August 20, 2010, supported by a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Mr. Raasch said upon review of the conditional use request, the Planning and Zoning Commission's approval of CU 10-06 to allow the on-site consumption of alcoholic beverages as allowed by the 2COP SRX state license, in conjunction with the operation of a restaurant located at 100 Live Oaks Boulevard would be based on the findings of fact and conclusions of the staff report dated August 20, 2010, and the following conditions: 1. The conditional use shall be limited to the location of 100 Live Oaks Boulevard. 2. All sales and consumption of alcoholic beverages shall be on-site and indoors. 3. Package sales of alcoholic beverages for off-site consumption are prohibited. 4. Hours of alcoholic beverage sales shall be Monday thru Sunday, 11:00 p:-r~: a.m, to 10:30 a+~: p.m. 5. The business shall remain in complete compliance with all City, County and State requirements, 6. There shall be no outside display or storage of goods, materials, services or vehicles. 7. The conditional use shall commence within 90 days of the approval. 8. The conditional use shall expire if the use is discontinued for more than 90 days. 9. All signage requires new permit approval and must comply with all city requirements. 10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void. Mr. Parkhurst asked the applicant to come forward. The applicant was not present at the meeting. Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the request. No one came forward. Mr. Parkhurst asked for a motion to address CU 10-06. Mr. Aramendia recommended approval of CU 10-06 Casselberry New Peking Buffet correcting condition number 4 in the staff report to read: "Hours of alcoholic beverage sales shall be Monday thru Sunday 11:00 a.m. to 10:30 p.m. and based on the staff report dated August 20, 2010 from Mr. Raasch to the Planning and Zoning Commission as presented. Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. Fifth Item of Business: ®ther Business.
