CEO Rivera stated this violation is for a septic tank that does not have a cover. Kathleen A. Hale made a motion to find Respondent(s) in CEB Case #10-00406 in violation of City Code, Section 86-31 (C)(3)(ID) and that such violation constitutes a serious threat to the public health, safety and welfare, and that Respondent(s) shall correct the violation before 1:00 p.m., 05/27/2010. If Respondent (s) fails to correct the violation by this date a fine in the amount of $500.00, per day will be imposed for each and every day the violation continues beyond the date set for compliance. In addition, if there is no compliance by this date, the Board requests that the City talcs appropriate action, if feasible, to accomplish all reasonable repairs or provide all services necessary to bring the property into compliance and Respondent(s) will be charged with the cost of such repairs and services in addition to the fine imposed. A Subsequent hearing will be held before this Board on 06/10/2010 to determine compliance by the aforestated date. IVIt•s. Hale amended the motion, fine to be $250.00 rather than $500.00 if not in compliance by the date set by the Board. David Henson seconded the motion. The motion passed unanimously.
