CEO Rivera stated this violation is for <br />a septic tank that does not have a cover. <br />Kathleen A. Hale made a motion to find Respondent(s) in CEB Case #10-00406 in violation of City Code, <br />Section 86-31 (C)(3)(ID) and that such violation constitutes a serious threat to the public health, safety and <br />welfare, and that Respondent(s) shall correct the violation before 1:00 p.m., 05/27/2010. If Respondent (s) <br />fails to correct the violation by this date a fine in the amount of $500.00, per day will be imposed for each <br />and every day the violation continues beyond the date set for compliance. In addition, if there is no <br />compliance by this date, the Board requests that the City talcs appropriate action, if feasible, to accomplish <br />all reasonable repairs or provide all services necessary to bring the property into compliance and <br />Respondent(s) will be charged with the cost of such repairs and services in addition to the fine imposed. A <br />Subsequent hearing will be held before this Board on 06/10/2010 to determine compliance by the aforestated <br />date. <br />IVIt•s. Hale amended the motion, fine to be $250.00 rather than $500.00 if not in compliance by the date set <br />by the Board. <br />David Henson seconded the motion. <br />The motion passed unanimously. <br />
