Board of Adjustment <br />November 19, 2009 <br />Page 3 <br />4. The applicant shall install hedge materials along Moonlit Lane which shad serve to screen the fence <br />from the roadway. These materials shall match the materials used on the neighboring properties to the <br />west. These materials shall be inspected and approved by City staff after installation. <br />5. The applicant shall seek separate approval from the Lost Lake Estates Homeowners Association prior <br />to construction of the proposed fence. The H4A authorization must be provided with the bu[[ding <br />permit application submittal. <br />6. The fence shall meet all other site development criteria, <br />7. A building permit for the fence shall be obtained from the C[ty's Building Safety Bureau within 60 days <br />of the approval by the Board of Adjustment and the certificate of completion shall be obtained with 920 <br />days of the issuance of the building permit. <br />8. All of the above candit[ons shall be fully and faithfully executed or the variance shall become null and <br />void, <br />Ms. Gauvin asked the applicant to come forward. Mr. Michael Savino, 839 Moonlit bane, Casselberry, Florida <br />came forward. Mr. Savino distributed a signed petition from the adjacent neighbors supporting the variance request (a <br />copy is attached and made a part of the minutes). Mr. Savino reviewed a PowerPoint presentation to the Board (a copy <br />is attached and made a part of the minutes}. Mr. Savino said he is not installing a pool enclosure. <br />Mr. Savino said he discussed the variance process with Mr. Senzee and staff suggested that he request a <br />second variance to modify the fence location to screen the pool equipment, Mr. Savino said he has not requested the <br />Architectural Review Board review the modification to the fence because the exact location of the fence has not been <br />determined. In response to the Board's concern regarding the specific fence location, Ms. Smith explained that the site <br />plan identifed as Exhibit B in the staff report shows the potential area for the fence. She said the fence is located 20' <br />from the road. Ms. Smith explained that the advertising was based on the proposed fence location shown in Exhibit B; <br />however, the Board can request a lesser request. She said that a variance cannot be approved that is greater than the <br />area advertised. <br />A general discussion ensued regarding these#back requirements for the fence, the currenk fence location and <br />any possible traffic visibility issues. Mr. Savino stated that the existing fence is located in the 5' landscape easement. He <br />said he would like to continue the fence to screen the pool and air conditioning equipment located on the side of the <br />garage, In response to the Board's question, Mr. Savino staked he continued the landscaping in the 5' landscaping <br />easement to fallow the theme of the subdivision's landscaping.
