Board of Adjustrnent <br />November 19, 2609 <br />Page 2 <br />Swimming fool Variance <br />Ms. Smith submitted a letter dated October 29,1009 (sic 2009) from the Lost Lake Estates HOA Inc. skating the <br />Architectural Review Board approved the pool application (a copy is attached and made a part of the minutes}. Ms, Smith <br />also submit#ed an email from Sentry Management dated November 18, 2009 stating lhatthe Architectural Review Board <br />approved the request for the pool location; however, the fence location has not been reviewed (a copy of the email is <br />attached and made a part of the minutes). <br />Ms. Smitio said the variance application meets 1 0# the 6 criteria for granting the variance; therefore, Cily staff <br />cannot fully support the request. She said if the Board of Adjustment chooses to grant the variance requested for BA 09- <br />06, for the property located at 831 Moonlit Lane, to allow a swimming pool and deck forward of the front building line, the <br />motion should be based upon the Board of Adjustment's findings of fact and conclusions, the property site plan (Exhibit <br />B), and the following conditions with the deletion of condition no. 2: <br />1, The variance shall only pertain to the proposed poolldeck shown in Exhibit B. A pool enclosure has <br />not been requested or approved at this time. The poolldeck shall meet all other site development criteria, <br />4. A building permit for the poolldeck shall be obtained from the City's Building Safety Bureau within 60 <br />days of the approval by the Board of Adjustment and the certificate of completion shall be obtained <br />with 12D days of the issuance of the building permit, <br />5. All of the above conditions shall be fully and faithfully executed or the variance shall become null and <br />void, <br />f=ence Revision Variance <br />Ms. Smith stated the variance appf ication meets 4 of the 6 criteria for granting the variance; therefore, City staff <br />cannot fully support the request. She said if the Board of Adjustment chooses to grant the variance requested for BA 09- <br />06, for the property located at 831 Moonlit Lane, to allow a 6 foot tall fence forward of the front building line, the motion <br />should be based upon the Board of Adjustment's findings of fact and conclusions, the property site plan (Exhibit 13j, and <br />the following conditions: <br />1. The variance shall only pertain to the proposed fence shown in Exhibit B, <br />2. The fence shall match the vinyl material used for the existing fence on the property. <br />3. The fence may not be located in the existing landscape easement. <br />
