She said that provides the ability to go forward with <br />the prosecution of this nature. <br />Ms. Drage said based on the fact that this is an ongoing matter, she recommended the City consider <br />extending the moratorium until the state wide prosecutor has an opportunity to move forward and possibility <br />complete his criminal prosecution of this matter. She recommended extending the moratorium for a minimum of 90 <br />days and at that point a decision could be made on how to proceed on this item. <br />A general discussion ensued regarding internet cafes, the issuance of a business tax receipt for this type of <br />establishment, the Attorney General's opinion regarding this type of operation, age restrictions for the internet cafe, <br />Ms. Smith and Ms. Drage site visits to internet cafes, and the non-profit status of the business. <br />Ms. Smith requested the Planning and Zoning Commission provide a favorable recommendation to the City <br />Commission to provide an extension to the moratorium for the internet cafes, sweepstake redemption centers, <br />arcades, etc. <br />Mr. Parkhurst asked for a motion to address LPA 10-04. Mr. Aramendia made a motion to provide a <br />favorable recommendation to the City Commission for an extension for the moratorium for internet cafes, <br />sweepstakes and arcades for an additional 90 days. Mr. Van Meter seconded the motion. The motion passed <br />unanimously by voice vote. <br />Sixth Item of Business: LPA 10-05: Fence ReplacementlAccess Structures. Amending the City of <br />Casselberry Code of Ordinances, Part III, Unified Land Development Regulations, Chapter II, District and <br />General Regulations to amend Article VII, Section 2-7.10, Fences and walls, to provide regulations permitting <br />the reconstruction and repair of legally existing non-compliant fences and walls. <br />Mr. Charles Senzee, Planner II, reviewed the information provided in his memorandum dated May 12, 2010, <br />to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Mr. Senzee requested that the Planning and Zoning Commission provide a favorable recommendation <br />to the City Commission for adoption of the proposed ULDR amendment. In response to the Commission's question, <br />Ms. Smith stated that the change to the fence height requirement would be addressed at a later time. <br />
