Planning & Zoning Commissionl <br />Local Planning Agency <br />May 12, 2010 <br />Page 3 <br />Commission provide a favorable recommendation to the City Commission to amend City Code Chapter 14 regarding <br />mobile carts and wagons. <br />A brief discussion ensued regarding regulations for existing mobile vendors, "temporary" open air food sales <br />for a maximum of 80 days per year and carpet sales. Mr. Parkhurst asked if there was anyone in the audience who <br />wished to speak in favor of, or in opposition to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address LPA 10-03. Mr. Aramendia made a motion to approve LPA 10- <br />03 mobile cart and wagon permits based on the staff report dated May 12, 2010 from Mr, Senzee to the Planning and <br />Zoning Commission with the elimination of Section 14.31 regarding fees and the fees would be adopted through <br />resolution. Mr. Hale seconded the motion. The motion passed unanimously by voice vote. <br />Fifth Item of business: LPA 10-04: Internet CafelSweepstakes Redemption. Amending the City of <br />Casselberry Code of Ordinances, Part III, Unified Land Development Regulations, to designate game rooms, <br />arcades, internet cafes, sweepstakes redemption centers and similar indoor entertainment and amusement <br />activities" as a "non-traditional use". <br />Ms. Sandra Smith, Chief Planner, explained in February 2010 the City Commission passed a moratorium <br />regarding the issuance of permits and licenses for the operation of businesses related to internet cafes, arcade, <br />sweepstakes redemption centers and those types of uses. Ms. Smith stated that Ms. Drage had some additional <br />information to present to the Planning and Zoning Commission and based on that information the Commission could <br />make a decision on how to move forward with this item. <br />Ms. Drage stated that she has been involved with the internet cafe and sweepstake redemption businesses <br />for approximately a year and a half. She said she had an opportunity to follow along with the prosecution of business <br />owners in other parts of the state and efforts to seek prosecution by the State Attorney in Seminole and Volusia <br />County. Ms, Drage said several months ago the City of Longwood raided a business similar to a business that is <br />now located in the City of Casselberry. She said they were part of a task force that investigated several of these <br />types of businesses in Seminole and Orange County and this information was forwarded to the state wide <br />prosecutor's office, She said the state wide prosecutor's office intends to go forward with the prosecution based <br />upon the fact that it believes this is an illegal gambling operation.
