Mr. Raasch stated upon review of the conditional use request, <br />the Planning and Zoning Commission's approval of CU 08-09 to allow the on-site consumption of alcoholic <br />beverages as allowed by the 1 COP SRX state license, in conjunction with the operation of a restaurant located at <br />103 East State Road 436, would be based on the findings of fact and conclusions of the staff report dated May 5, <br />2010, and the conditions stated in the staff report which were: <br />1. The conditional use shall be limited to the location of 103 East SR 436. <br />2. All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />3. Package sales of alcoholic beverages for off-site consumption are prohibited. <br />4. Sales of alcoholic beverages through the drive-thru window are prohibited. <br />5. Hours of alcoholic beverage sales shall be Monday thru Sunday, 12:00 p.m. to 12:00 a.m. <br />6. The business shall remain incomplete compliance with all City, County and State requirements, <br />7. There shall be no outside display or storage of goods, materials, services or vehicles. <br />8. The conditional use shall commence within 90 days of the approval. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All signage requires additional permit approval and must comply with all city requirements. <br />11. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />Mr. Parkhurst asked the applicant to come forward. The applicant was not present at the meeting. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />Mr. Parkhurst asked for a motion to address CU 10-05. Mr. Aramendia recommended approval of CU 10-05 <br />Pancho's Mexican Food based on the staff memo dated May 5, 2010 from Mr. Raasch to the Planning and Zoning <br />Commission as presented. Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. <br />Fourth Item of business: LPA 10:03: Amusements- Outdoor food sales. Amending the City of Casselberry <br />Code of Ordinances, Part II, Chapter 14, Amusements, to amend open air food sale requirements to restrict <br />mobile vending carts and wagons and to amend affected permit fee requirements. <br />Mr. Charles Senzee, Planner II, reviewed the information provided in his memorandum dated May 12, 2010 <br />supported by a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (a copy is on <br />file in the Community Development Department). Mr. Senzee stated the proposed code amendments are indicated <br />in the ordinance that was provided with the staff report; however, staff recommends that the fees should be removed <br />from this section and adopted by resolution. Mr. Senzee requested the Planning and Zoning Commission include <br />this change within their recommendation to the City Commission. Mr. Senzee requested the Planning and Zoning <br />
