He said based upon that fact, staff recommends approval of the conditional use <br />request. <br />He said if the Planning and Zoning Commission chooses to approve CU 10-03 to allow anon-traditional use <br />(pawn shop) at 1555 State Road 436, the motion should be based on the staff report dated April 26, 2010, the <br />stacking plan shown as Exhibit D in the staff report, the Planning and Zoning Commission's findings of fact, and the <br />conditions of approval which were: <br />1. The conditional use shall be limited to tenant spaces 1201-1241 as shown in Exhibit D. The pawn shop <br />use may not be expanded or enlarged without additional approval from the Planning and Zoning <br />Commission. <br />2. According to ULDR Section 2-7.30, only one non-traditional use may be located in each shopping <br />center. In order to meet this requirement the existing tattoo parlor within Grindle Village shall be closed <br />and its Business Tax Receipt deactivated prior to the issuance of a Business Tax Receipt or any <br />building permit specifically related fo the pawn shop use. eatiee. <br />3. The design and color of the structure shall continue to be painted in muted colors and finished in <br />materials consistent with the surrounding area and character of the City as required by Ordinance 10- <br />1313. The building shall be maintained in a neat, clean, and orderly condition. <br />4. There shall be no security bars on the outside of doors or windows which are visible from the public <br />right of way. <br />5. Exterior phones and roll up doors are prohibited. <br />6. Windows shall not be obscured by the placement of signs, dark window tinting, shelving, racks, or <br />similar obstructions. <br />7. The pawn shop may only operate between the hours of seven (7:00) am and eleven (11:00) pm. <br />8. The applicant shall obtain all necessary building permits for interior alterations, exterior work, and <br />signage within one (1) year of the conditional use approval. <br />9. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />A brief discussion ensued regarding security bars and the reason for requesting the conditional use before <br />the tattoo business vacates the site. Mr. Parkhurst asked the applicant to come forward. Mr. Pat Goetz, <br />representing the landlord, 1222 Vassars Street, Orlando, Florida came forward. Mr. Goetz explained that the tattoo <br />parlor has been located in the plaza for several years and has been a good tenant. Mr. Goetz stated that the <br />business owner for the tattoo parlor has been put on notice that his lease would not be renewed in September 2010. <br />He said they are attempting to find him a new location to relocate his business. Mr. Goetz stated that he would <br />provide documentation to the Board stating that the tattoo business lease would not be renewed. <br />Mr. Goetz stated he would like the opportunity to begin construction or at least the permitting process to <br />assist the pawn shop in opening their business as soon as possible. <br />
