Planning & Zoning Commissionl <br />Local Planning Agency <br />April 28, 2010 <br />Page 3 <br />In response to the Commission's question regarding condition no. 2, Mr. Goetz stated that they would like to <br />commit the space to the pawn shop tenant so that she can start the process to open her business. He said it could <br />take up to September 30 if they are unable to relocate the tattoo tenant. Mr. Senzee stated that the applicant has the <br />right to pull building permits to work on the space if it does not relate specifically to the pawn shop use. He said the <br />tenant could do a "white box" build out. A general discussion ensued regarding the extent of the construction work <br />that would be allowed before the tattoo business vacated the site. Mr. Senzee suggested changing the wording of <br />condition no. 2 to state: for issuance of a business tax receipt or any building permit specifically related to the <br />pawn shop use. He said that would allow the applicant to combine the spaces, deal with the fire wall, separation <br />issues and the "white box" build out. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />A discussion ensued regarding condition no. 4 regarding the installation of security bars on the inside of the <br />facility and condition no. 6 regarding tinting of the windows. Mr. Senzee stated that the conditions of approval in the <br />staff report were taken directly from the City's ordinance regarding non-traditional uses. <br />A general discussion ensued regarding the tattoo parlor tenant vacating the site and the execution of <br />proposed pawn shop tenant's lease <br />Mr. Parkhurst asked for a motion to address CU 10-03. Mr. Aramendia recommended approval of CU 10-03 <br />Non-traditional use for the pawn shop at 1555 State Road 436 based on the staff report dated April 26, 2010 from Mr. <br />Senzee to the Planning and Zoning Commission as presented with a change to staff condition no. 2 to read: For any <br />building permits specifically relating to the pawn shop use.
