Planning & Zoning Commissionl <br />Local Planning Agency <br />March 10, 2010 <br />Page 2 <br />Mr. Aramendia moved to accept the February 24, 2010 minutes with the exclusion of what the Chairman <br />had stated as presented. Mr. Weinroth seconded the motion. The motion passed unanimously by voice vote, <br />Second Item of Business: Disclosure of Ex Parte Communications. <br />No disclosure of Ex Parte Communications was made by the Commissioners. <br />Third Item of Business: CU 10-01:225 Lake Ellen DrivelA. Colon. Conditional use request for a dock. <br />Mr. Charles Senzee, Planner, reviewed the information provided in his memorandum dated March 5, 2010 <br />supported by a PowerPoint presentation to the City of Casselberry Planning and Zoning Commission (copies are on <br />file in the Community Development Department). Mr. Senzee stated Staff finds that the design of the proposed use <br />is compatible with the surrounding land uses. He said if the Planning and Zoning Commission chooses to approve <br />CU 10-01 to allow a private residential dock at 225 Lake Ellen Drive, the motion would be based on the staff report <br />dated March 4, 2010, the site drawing attached as Exhibit B in the staff report, the dock design attached as Exhibit D <br />in the staff report, the Planning and Zoning Commission's findings of fact, and the conditions outlined in the staff <br />report which were: <br />1. The conditional use shall be limited to the existing dock structure. The dock shall not be enlarged or <br />enhanced in any way without additional conditional use approval by the Planning and Zoning <br />Commission. <br />2. The construction and maintenance of the dock shall be in accordance with the requirements of all <br />applicable state agencies and the City's ULDR. <br />3. A building permit for the dock shall be obtained within 60 days of the approval and a final inspection <br />shall be obtained within 120 days of the issuance of the building permit. <br />4. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />A general discussion ensued regarding lighting requirements for docks, the existence of other floating docks <br />on the lake, installation of the dock, a survey for existing docks on the various lakes to determine if docks were <br />permitted, and penalties for unpermitted work. <br />Mr. Parkhurst asked the applicant to come forward. Mr. Senzee stated that the applicant was not present at <br />the meeting. <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br />to, the request. No one came forward. <br />
