Motion was seconded by Commissioner Hufford. Motion carried <br />unanimously by voice vote 5 - 0. <br />C. First Reading of Ordinance 10-1330 -City Code Amendment to Chapter 14 - <br />Amusements, Related to Mobile Vendors <br />The City Clerk read Ordinance 10-1330 by title as follows: <br />"AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF CASSELBERRY, FLORIDA, <br />AMENDING THE CITY OF CASSELBERRY, FLORIDA, CODE OF ORDINANCES, PART H, <br />CHAPTER 14, AMUSEMENTS, AMENDING SECTION 14-28, PERMIT REQUIRED, <br />ELIMINATING AN EXEMPTION FROM PERMITTING; AMENDING SECTION 14-31, PERNHT <br />FEE, ELMINATING THE PERMIT FEE SCHEDULE; AMENDING SECTION 14-53, OPEN AIR <br />FOOD SALES, PERMFORMANCE CRITERIA, TO IMPOSE VENUE AND LOCATION <br />RESTRICTIONS ON OPEN AIR FOOD SALES, INCLUDING MOBILE FOOD VENDING CARS <br />AND WAGONS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE." <br />Staff Presentation: Ms. Sandra Smith, Chief Planner, stated Ordinance 10-1330 provides for amendments to <br />Chapter 14 of the City Code to allow changes to the permit fee schedule by resohrtion, to eliminate mobile <br />vendors as an accessory use to a permanent business, to eliminate the City from being exempt from obtaining <br />event permits, and to allow mobile vendors for• open air sales, seasonal sales and special events. The Planning <br />and Zoning Commission recommended approval of Ordinance 10-1330 at its May 12, 2010 meeting. <br />Budget Impact: There is no impact to the City Budget. <br />Audience Participation: The following individuals came forward to address Ordinance 10-1330: <br />1) Mi•. Craig Tull, 420 Ranch Trail, spoke in opposition to Ordinance 10-1330. <br />2) Mr. James Fraleigh, 1290 Seminola Boulevard, spoke in opposition to Ordinance 10-1330. <br />MOTION: Commissioner Hufford moved to approve Ordinance 10-1330 on first reading, <br />as presented. Motion was seconded by Vice Mayor Solomon. <br />
