Ms. Smith requested the Commission include this document as Exhibit M to the staff report and <br />if the Commission approves the conditional use that a condition is added fo the staff recommendations that the <br />document is executed prior to issuance of a building permit. <br />Ms. Smith said the Planning Division Staff recommends approval of CU 09-10 for use as a convalescent <br />care facility, based upon the various site plan sheets da#ed October 30, 2009, the parameters of the use provided <br />within the development order, and the staff report dated November 13, 2009, and the conditions outlined in the staff <br />report which are: <br />1. The proposed use shalt be limited to "Unit 3B" as identified on the site plan and the areas provided <br />within the Access and Space Use Agreement" executed between Pathways to Care and Pathways to <br />independence. This agreement must be signed and recorded prior to issuance of a building permit. <br />2. The City of Casselberry pevelopment Order, attached to this staff report as Exhibit B, shall be executed <br />prior to issuance of a building permit. The document shall be revised to include a three month <br />maximum length of stay at the facility and to eliminate "chronic medical conditions (including but not <br />limited to diabetes, hypertension, hyperlipidemia, chronic obstructive pulmonary disease etc)" used to <br />define" infirmed". <br />3. The primary use of the property is to be as a convalescent care facility provided to the elderly or <br />infirmed as defined in the development order, <br />~. The design and operation of the structure must adhere to the requirements of all regulatory agencies, <br />the Florida Building Code, Nl"PA, and City of Casselberry Public Works Department, Building Division <br />and Fire Marshal. <br />5. A maximum of ten bedrooms with a maximum twenty beds total shall be provided. <br />6. Outpatient services are to include physical rehabilitation and occupational therapy. The outpatient <br />services will be extended only to those persons who were convalescent patients of the facility, <br />7. The maximum average length of stay shall not exceed three months, <br />8. All business tax receipts, permits, certifications and inspections by the City of Casselberry, Seminole <br />County and the State of Florida and any other regulatory agencies shall be obtained, completed and <br />kept current at all times, or the conditional use shall become nu11 and void. <br />9. The operation of the convalescent care facility shall begin wl#hin twelve months of the conditional use <br />approval. <br />10, If the convalescent care facility changes names or ownership, a new conditional use applicafian review <br />shall be required within sixty (60} days of the change. <br />11. If the convalescent care facility ceases operations for a period of ninety (90} days or more, the <br />conditional use shall become null and void. <br />12. All conditions shall be executed, or the conditional use shall become null and void. <br />Ms. Smith stated the majority of the conditions are included in the Development Order with the exception of <br />0 through the remainder of the document, Ms. Smith requested that the Development Order be amended as stated <br />in condition number 2 of the staff report to include the three month maximum length of stay at the facility and also to <br />eliminate "chronic medics[ conditions (including but not limited to diabetes, hypertension, hyperlipidemia, chronic <br />obstructive pulmonary disease etc)" used to define "infirmed. Ms. Smith said that the term "infirmedn should be <br />referred to as weak, feeble of body or mind. Ms. Smith requested "1" of the Development Order be amended to read: <br />
