Planning & Zoning Commission) <br />Local Planning Agency <br />Feiorc~ary 10> 2010 <br />Page 4 <br />He expressed a concern with the trespassing and the use of recreational vehicles on the property. Mr. Rosenberg <br />felt that a lower density would be more appropriate to fit with the character of the neighborhood and an R12.5 zoning <br />designation would be appropriate for the area. Mr. Rosenberg felt that the R12.5 would be consistent with the <br />neighborhood, a good use of the land and it could also compel the owner to discontinue the use of recreational <br />vehicles on the property and possibly fence and post the property, <br />Ms. Smith skated tonight's meeting is not to discuss the development of the property, She said the concerns <br />that were expressed at tonighf's meeting would be addressed when the property is reviewed for development. She <br />said the trespassing and the use of recreational vehicles is a police matter and an issue with the property owner. Ms. <br />Smith said the lowest density future land use application is LDR (low density residential} which is similar to the <br />County's tow density residential Ms. Smith said the County's zoning of Al allows one dwelling unit per acre and the <br />City's R8 equates to flue dwelling units per acre which is the maximum build out with a low density residential future <br />(and use designation. Ms. Smith explained that the R12,5 designation equates to three dwelling units per acre. She <br />said the City does not have a designation that allows only one or two dwelling units per acre. The R12.5 zoning <br />designation is the lowest development that could be provided on the site. Ms. Smith said if the Local Planning <br />Agency feels that the R12.5 zoning classification is appropriate it needs to be included in their recommendation to the <br />City Commission. <br />In response to the Board's question, Ms, Smith said this item would be scheduled for first reading by the <br />Gify Commission and then will be forwarded to the Department of Community Affairs (DCA}. She said DCA has 60 <br />days to review the information and they will provide the Cily with the Objections, Recommendations and Comment <br />Report (ORC}. She said the City then has 60 days to address DGA's comments regarding the City's application. <br />A brief discussion ensued regarding annexation, annexation petitions, trespassing and the proposed zoning <br />designation for 1466 Bird Road, Mr. Parkhurst asked for a motion to address LPA 09-02. Mr. Aramendia <br />recommended a favorable recommendation to the City Commission for LPA 09-02 based on the staff report dated <br />January 27, 2010 from Ms. Smith to the Local Planning Agency as presented including the following change to lots 5 <br />and 6 on Ruby Court (Map C}from County Office to Gify Commercial. <br />
