Planning & Zoning Cammissionl <br />Local Planning Agency <br />January 13, 2a1o <br />page 6 <br />Ms. Sandra Smifh, Chief Planner, explained That the next four agenda items are requests for extensions to <br />previously approved site plans or conditional use approvals. Ms. Smith explained that Section 4-18.5 of the tJni#ied <br />Land Development Code states that site plans and other approvals such as conditional uses may be continued for up <br />to 12 months by a favorable vote of the Planning and Zoning Commission if the applicant can show reasonable <br />cause for the extension. Ms. Smith said this summer the Legislature passed Senate Bill 360 that included an <br />automatic two year extension for all development approvals that were scheduled to expire between September 2008 <br />and January 1, 2012. She said based on this legislation an automatic extension would have been granted to these <br />approvals; however, the legislation has been challenged and the outcome is unknown. Ms. Smifh said that the City <br />Attorney has advised staff that the best route to take to ensure a valid development approval extension is through the <br />City Code. <br />Ms. Smith reviewed the following extensions: <br />1. Lake Drive Assisted Living Facility -conditional use approval extended to December 10, 2010 <br />2. Kingdom Hall--site plan approval extended to November 12, 2010 <br />3, Legacy Park Phase 3 -site plan approval extended to December 10, 2010 <br />4. Legacy Park Phase 3 -plat approval extended to April 14, 2011 <br />5. Geneva School -site plan approval extended to February 23, 2011 <br />Ms. Smith stated based on certain conditions it is generally the site plan that was approved by the Planning <br />and Zoning Commission. Ms. Smith requested a separate motion for each agenda item if the Planning aril Zoning <br />Commission is in agreement to go forward with these approvals based on the conditions of approval that were <br />attached in the staff reports. <br />In response to the Commission's question, Ms. Smith stated that the City Code allows a maximum one year <br />extension far site plans. A general discussion ensued regarding the status of the various projects. <br />Fifth Item of Business: CU 09.13: Lake Drive Assisted Livin l=acilit Extension, Request to a one year <br />extension far the conditional use approval (CU 48.12) to construct an assisted living facility at '[316, 1324, & <br />1331 Lake Drive. <br />Mr. Parkhurst asked the applicant to come forward.
