CASSELBERRY CITY COMMISSION <br />Minutes of January 25, 2010 -Regular Meeting <br />Page 7 of 19 <br />MORATORIUM FOR 180 DAYS ON THE ISSUANCE OF ANY BUSINESS TAX LICENSE, <br />PERMIT, CONDITIONAL USE APPROVAL, SITE PLAN APPROVAL AND ANY OTHER <br />OFFICIAL ACTION OF THE CITY OF CASSELBERRY HAVING THE EFFECT OF <br />PERMITTING OR ALLOWING THE CONSTRUCTION AND/OR OPERATION OF CERTAIN <br />BUSINESSES WITHIN THE CITY OF CASSELBERRY, RELATED TO, GAME ROOMS, <br />ARCADES, INTERNET CAFES, SWEEPSTAKES REDEMPTION CENTERS AND SIMILAR <br />INDOOR ENTERTAINMENT AND AMUSEMENT ACTIVIITES AS MORE SPECIFICALLY <br />DESCRIBED IN THIS ORDINANCE; THE TEMPORARY MORATORIUM SHALL APPLY TO <br />ALL REAL PROPERTY LOCATED WITHIN THE CORPORATE LIMITS OF THE CITY OF <br />CASSELBERRY; PROVIDING A PROCEDURE FOR EXTRAORDINARY HARDSHIP; <br />PROVIDING FOR SEVERABILTTY, CONFLICTS, AND AN EFFECTIVE DATE." <br />Notice of Public Hearing: The Notice of Public Hearing relative to Ordinance 10-1312 was published in the <br />Orlando Sentinel on January 14, 2010. <br />Staff Presentation: Mr. Don Martin, Community Development Director, stated Ordinance 10-1312 provides <br />fora 180 day moratorium on the issuance of all City approvals for arcades, Internet cafes, sweepstakes <br />redemption centers and similar uses. Staff will develop findings and determine if criteria are needed for the <br />location of these specific businesses within the City. <br />Budget Impact: This item does not impact the City's Budget. <br />Recommendation: The City Manager and the Community Development Director recommended approval of <br />Ordinance 10-1312 on first reading. <br />Public Hearing: The following individuals came forward to address Ordinance 10-1312: <br />1) Mr. James Fraleigh, 1290 Seminola Boulevard, spoke in opposition to Ordinance 10-1312. <br />2) Mr. John Casselberry, 700 South Lost Lake Lane, spoke in favor of Ordinance 10-1312 as long as it <br />did not affect non-gambling arcades. <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 10-1312. <br />MOTION: Commissioner Doerner moved to approve Ordinance 10-1312 on first reading <br />as presented. Motion was seconded by Commissioner Hufford. Motion carried <br />unanimously by voice vote 5 - 0. <br />10. FIRST READING OF ORDINANCES <br />No items were scheduled on this agenda. <br />
