<br />Planning & Zoning Commission! <br />Local Planning Agency <br />August 12. 2009 <br />Page 4 <br /> <br />2. All sales and consumption of alcoholic beverages shall be and indoors. <br />3. The drive-thru window shall not be operated for any purposes without additional conditional use <br />and approval. At no time shall the drive-thru window be used for the of alcoholic beverages. <br />4. Sales of alcohol shall be for beer and wine only (2COP). Package sales of alcoholic beverages for <br />site consumption are prohibited. <br />5. The sale of alcohol shall be incidental to the sale of food and shall occur in conjunction the <br />down restaurant operation. <br />6. The business shall remain in complete compliance with all City, County and State requirements. <br />7. There shall be no outside display or storage of goods, materials, services or vehicles. <br />8. The conditional use shall commence within 90 days of the approval. <br />9. The conditional use shall expire if the use is discontinued more than days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />and void. <br /> <br />A general discussion ensued regarding the hours of operation for the restaurant, hours allowed <br /> <br /> <br />of alcohol beverages and parking requirements. <br /> <br />Mr. Parkhurst asked the applicant to come forward. Mr. John Dobson, 1410 State Road <br /> <br /> <br />Florida came forward. Mr. Dobson stated that it is a family dining restaurant that <br /> <br /> <br />and wine. <br /> <br />said in <br /> <br />past the total beer and wine sales totaled approximately 8% of their sales. <br /> <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of. or in <br /> <br />to, the request. No one came forward. <br /> <br />Mr. Parkhurst asked for a motion to address CU 09-08. Mr. Aramendia recommended approval of CU <br /> <br />based on the staff report dated August 6, 2009 from Mr. Senzee to the Planning and <br /> <br />Commission as <br /> <br />presented. Mr. Van Meter seconded the motion. <br /> <br />motion passed unanimously <br /> <br />vote. <br /> <br />Fifth Item of Business: ZB 09-05: Home Occupations. Amend Part III, Unified land Development <br />Regulations, Chapter II, District and General Regulations to amend Article VII, Section 2-7.11, Home <br />Occupations. <br /> <br />Mr. Charles Senzee, Planner, reviewed the information provided in his memorandum dated August 7, <br /> <br />to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br /> <br />Department). <br /> <br />A general discussion ensued regarding retail sales, sale of adult entertainment items, home parties <br /> <br />animal rescue/shelters at residential properties. <br />
