He said the applicant initially requested a 9 month transition period to <br /> <br />phase out the existing restaurant use; however, after reviewing the staff report the applicant would like to request <br /> <br />additional time to allow for site plan approval and construction. Mr. Senzee stated that staff has no objections to <br /> <br />granting 12 months from the date of approval to complete the site improvements and open for business. <br /> <br />Mr. Senzee stated that the applicant has requested expanding the hours of operation. Mr. Senzee reviewed <br /> <br />the proposed hours of operation shown in the staff report, the applicant's newly proposed hours of operation and the <br /> <br />operating hours for the existing Holler business (a copy of that information is attached and made a part of the <br /> <br />minutes). Mr. Senzee stated that staff could support hours of operation similar to the Holler business. <br /> <br />Mr. Senzee said staff finds that the proposed use is compatible with the surrounding land uses. He said <br /> <br />staff recommends approval of the conditional use request pending approval of a site plan review. Mr. Senzee said, if <br /> <br />the Planning and Zoning Commission chooses to approve CU 09-04 to allow an automotive <br /> <br />and service at <br /> <br />1870 State Road 436, the motion should be based on the staff report dated July 1,2009, the conceptual site drawing <br /> <br />received June 24, 2009, the Planning and Zoning Commission's findings of fact, and the conditions of approval <br /> <br />outlined in the staff report with modification to condition number 1 and 2 and possibly to condition number 11 - hours <br /> <br />of operation: <br /> <br />1. The applicant shall undergo site plan review within ~ twelve (12) months for the subject property <br />in accordance with Chapter IV, Section XVIII "Site Plan Review" of the Casselberry Unified Land <br />Development Regulations. No automotive sales or service activity shall take place on the property prior <br />to site plan approval and site construction permit issuance. <br />2. The automotive sales and service business shall open for business within nino (9) months twelve <br />of this conditional use approval (April 7,2010). <br />3. The area approved for conditional use shall be comprised of a single business location. <br />4. The owner of the automotive business shall obtain a Business Tax Receipt from the City of Casselberry <br />prior to commencement of business operations. <br />5. All signage requires permit approval and must comply with all city requirements. A permit application <br />shall be submitted to the Casselberry Building Division for any new signage on the property. Any <br />signage not approved during this process shall be immediately removed. Temporary, attention getting <br />devices shall not be used on-site, including on individual vehicles. <br />6. The site shall meet the City's current exterior lighting regulations. A photometric inspection shall be <br />conducted by Community Development staff prior to completion of the project. Any lighting deemed <br />unacceptable by staff shall be removed and/or replaced. <br />7. The on-site automobile inventory shall not be placed within any parking area or required traffic lanes <br />which are required for employee or customer use by Casselberry's Unified Land Development <br />Regulations. The maximum number of permitted inventory vehicles shall be established during the site <br />plan review process. <br />
