Conditional use request to allow a <br />trades and skilled services use without outside storage in an I zoning district. <br /> <br />Mr. Charles Senzee, Planner, reviewed the information provided in his memorandum dated May 8, 2009, to <br /> <br />the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br /> <br />Department). Mr. Senzee said that the applicant provided a basic floor plan indicating how the structure will be <br /> <br />utilized (a copy is on file in the Community Development Department). <br /> <br />Mr. Senzee said staff finds that the proposed use is compatible with the surrounding land uses. He said <br /> <br />should the Planning and Zoning Commission choose to approve CU 09-07 to allow a trades & skilled service without <br /> <br />outside storage at 175 Anchor Road, the motion should be based on the staff report dated May 8, 2009, the site <br /> <br />drawing (Exhibit B), the Planning and Zoning Commission's findings of fact, and the conditions outlined in the staff <br /> <br />report which were: <br /> <br />1. The conditional use shall be limited to the existing 5,920 square foot structure. No expansion of the <br />structure or site may occur without additional Planning and Zoning Commission approval. <br />2. The area approved for conditional use shall be comprised of a single business location. <br />3. The applicant shall submit a site plan showing striped parking which meets the requirements of the <br />ULDR's. This plan shall be reviewed and approved by City staff within 90 days of conditional use <br />approval. <br />4. The business shall remain in complete compliance with all City, County, and State requirements. <br />5. There shall be no outside display or storage of goods, materials or services. <br />6. The conditional use shall commence within 90 days of the approval. <br />7. The conditional use shall expire if the use is discontinued for more than 90 days. <br />8. The subject property is considered to be a non-compliant site. As such, it shall comply with the <br />requirements of Article VIII Nonconforming Uses and Noncompliant Structures. Any future site or <br />building modifications may require additional upgrades in order to be brought into compliance with <br />current development requirements <br />9. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br />
