Planning & Zoning Commission!
Local Planning Agency
May 13, 2009
Page 3

He said that he visited three other car washes. He said that 99 percent of car washes do not provide parking spaces

because the consumers' vehicle is parked inside the tunnel while the car is being washed.

Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in opposition

to, the request. Ms. Brenda Midulle, Simonz Car Wash Regional Administrator, 1325 State Road 436, Casselberry,

Florida came forward. Ms. Midulle said the hot dog cart would be beneficial to their customers, the employees and

the adjacent Mobile Lube business.

Ms. Colleen Hufford, 527 Queens Mirror Circle, Casselberry, Florida came forward to speak against the

request. Ms. Hufford stated that she served on the Planning and Zoning Commission Board for four years. Ms.

Hufford suggested permitting open air sales as a more appropriate process than the conditional use process. Ms.

Hufford said a limit could be placed on the number of open air sales permitted for the community. Ms. Hufford was

concerned with an increase in outdoor sales and the possible ramifications that could occur in the City.

A general discussion ensued regarding the permitting process, open air sales, review of the conditional use

review process, parking and the proposed changes to the site. Mr. Parkhurst asked for a motion to address CU 09-

05. Mr. Hale recommended approval of CU 09-05 to use a portion of an existing commercial property to be used for

open air food sales based on the staff report dated May 7, 2009 from Mr. Senzee with the modifications that were

included in the staff report. Mr. Aramendia seconded the motion.

The Board was polled.

Anthony Aramendia Yes
Nathan Van Meter No
Marlene Hyde No
Harley Parkhurst No
Edmund Bakalla No
Daniel Hale Yes
John VonLangen No

The motion to approve the hot dog cart failed with a majority vote.

Mr. Aramendia made a motion to remand the conditional use process to the City Commission for

consideration of rewriting the current ordinance. Mr. Hale seconded the motion.

The Board was polled.
