<br />Planning & Zoning Commissionl <br />Local Planning Agency <br />May 13, 2009 <br />Page 2 <br /> <br />Mr. Charles Senzee, Planner, reviewed the information provided at the April 23, 2009 Planning and Zoning <br /> <br />Commission meeting in his memorandum dated May 7, 2009, to the City of Casselberry Planning and Zoning <br /> <br />Commission (a copy is on file in the Community Development Department). Mr. Senzee reviewed slides of the site <br /> <br />including photographs, the proposed location of the hot dog cart and the site layout (copies are attached and made a <br /> <br />part of the minutes). <br /> <br />Mr. Senzee stated the Planning and Zoning Commission recommendation for approval of CU 09-05 to allow <br /> <br />a portion of an existing commercial property to be used for open air food sales via a hot dog cart at 1325 State Road <br /> <br />436, would be based on the staff report and exhibits dated April 16, 2009, the revised site drawing submitted May 6, <br /> <br />2009 (Exhibit B), the staff memo dated May 7, 2009, the Planning and Zoning Commission's findings of fact, and the <br /> <br />revised conditions included in the staff report which were: <br /> <br />1. The conditional use shall be limited to the operational area and cart style shown in Exhibit D. No <br />expansion of the operational area or enlargement of the cart may occur without additional Planning and <br />Zoning approval. <br />2. The area in which the hot dog cart will be placed shall be striped or otherwise distinguished for <br />pedestrian safety purposes as shown in Exhibit B. The applicant shall submit a site plan for Public <br />Works approval within 30 days of conditional use approval. The completed striping shall pass Public <br />Works and Community Development inspection prior to the issuance of a business tax receipt for the <br />subject business. <br />3. Conditional use approval is for the outdoor sale of food items only. The sale of any other materials, <br />products, or services from the subject hot dog cart is strictly prohibited. <br />4. The five (5) easternmost parking spaces on the property shall be used solely for employee and <br />customer parking. The existing tent structure shall be removed and no automotive detailing or outdoor <br />work of any kind shall occur within this area. <br />5. This conditional use approval is solely for open air food sales via a hot dog cart. No additional outdoor <br />activities, seating, or events associated with this business will be permitted. <br />6. Hours of operation shall be Monday-Saturday 9:00am - 6:00pm. <br />7. The business shall remain in complete compliance with all City, County and State requirements. <br />8. There shall be no outside display or storage of goods, materials, services. The only exception to this <br />will be the outdoor food sales approved as part of this conditional use. <br />9. The conditional use shall expire if the use is discontinued for more than 90 days. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br /> <br />Mr. Parkhurst asked the applicant to come forward. Mr. Jorge Mendoza, 588 Lake Howell Lane, <br /> <br />Casselberry, Florida came forward. Mr. Mendoza said that the Regional Administrator for the car wash is available to <br /> <br />answer any questions. Mr. Mendoza stated that he would stripe the hot dog cart area similar to the Home Depot site. <br />
