<br />Planning & Zoning Commission! <br />Local Planning Agency <br />May 6, 2009 <br />Page 4 <br /> <br />Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. <br /> <br />Casselberry suggested connecting the existing bike path along the eastern half of the elementary school <br /> <br />complex and the path along the northern edge of the middle school property, He felt this would save <br /> <br />money. Mr. Casselberry expressed a concern with the intrusion of the public in the recreation area of the <br /> <br />school property. Mr. Casselberry expressed a concern with a change to the zoning and land use for the <br /> <br />bike path. <br /> <br />After a brief discussion, Mr. Parkhurst asked for a motion to address SPR 09-01. Mr. Aramendia <br /> <br />recommended approval of SPR 09-01 based on the staff report dated April 30, 2009 from Mr. Senzee to <br /> <br />the Planning and Zoning Commission as presented with the corrections to the subdivision names as stated <br /> <br />earlier. Mr. Van Meter seconded the motion, The motion passed unanimously by voice vote. <br /> <br />Fourth Item of Business: CU 09-06 1385 State Road 436/Shaker's lounge: Extension of a <br />conditional use approval for CU 09-02 for alcohol sales for a bar/lounge in a CG zoning district. <br /> <br />Mr. Charles Senzee, Planner, reviewed the information provided in his memorandum dated <br /> <br />30, 2009, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community <br /> <br />Development Department). Mr. Senzee said based upon the number of outstanding issues and the <br /> <br />applicant's progress to date, staff recommends approval of the requested 60 day extension. He said if the <br /> <br />Planning and Zoning Commission chooses to approve a 60 day extension for Shaker's Lounge, located at <br /> <br />1385 State Road 436, the motion should be based on the findings of fact and conclusions of the staff report <br /> <br />dated January 23, 2009, the exhibits from the January 28, 2009 meeting, this staff report dated April 30, <br /> <br />2009 and the revised conditions in the staff report which were: <br /> <br />1. The conditional use shall be limited to the existing 7,338 square foot structure. No expansion <br />of the structure or site may occur without additional Planning and Zoning approval. <br />2. This conditional use approval shall expire and become null and void for all purposes on <br />January 28,2014. <br />3. The conditional use activity shall occur only so long as the use is operated with a 2-COP, <br />COP or equivalent license in force at all times. <br />4. The area approved for conditional use shall be comprised of a single business location. <br />
