The conditional use shall commence within 60 days of the extension approval date, <br />(July 6, 2009). <br />12. The conditional use shall expire if the use is discontinued for more than 90 days. <br />13. All signage requires additional permit approval and must comply with all city requirements. <br />14. Canopy trees shall be provided every 35' on center along the western property line of the <br />property prior to opening, Sod or landscaping shall also be provided within the existing <br />landscape islands. The applicant shall submit an acceptable landscape plan to Community <br />Development staff as soon as possible, The site shall pass a landscape inspection prior to <br />opening, <br />15. The site shall meet the City's current exterior lighting regulations wherever possible. A <br />photometric inspection shall be conducted by Community Development staff prior to opening, <br />Any lighting deemed unacceptable by staff shall be removed and/or replaced placed prior to <br />opening. <br />16. The applicant shall provide irrigation for all new landscape material in a manner consistent with <br />the City's Unified Land Development Regulations, <br />17. All of the above conditions shall be fully and faithfully executed or the conditional use shall <br />become null and void. <br /> <br />After a brief discussion, Mr. Parkhurst asked the applicant to come forward, Mr. Larry Powalisz, <br /> <br />1385 State Road 436, Casselberry, Florida came forward. Mr. Polwalisz said that the construction has <br /> <br />taken much longer than anticipated. He said the grand opening is scheduled for June 5, 2009. Mr. <br /> <br />Powalisz said a 90 day extension would be acceptable to him to allow for any possible delays. <br /> <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in <br /> <br />opposition to, the request. No one came forward. <br /> <br />Mr. Parkhurst asked for a motion to address CU 09-06, Mr. Aramendia recommended approval of <br /> <br />CU 09-06 based on the staff report dated April 30, 2009 from Mr. Senzee to the Planning and Zoning <br /> <br />Commission with the change to Condition No. 11 from a 60 day extension to a 90 day extension as <br /> <br />presented. Mr. Weinroth seconded the motion. The motion passed unanimously by voice vote, <br />
