Mr. Luis Cruz, Parks Manager, gave a <br /> <br />PowerPoint presentation to the Planning and Zoning Commission (a copy is attached and made a part of <br /> <br />the minutes), Mr. Cruz said that Mr. Gary Warner, Glatting Jackson, was also available to answer <br /> <br />questions. Mr. Aramendia indicated that corrections were needed to some of the subdivision names <br /> <br />referenced on the site plan so that the applicant could ensure the correct names are provided. <br /> <br />A general discussion ensued regarding a future trail connection to Dew Drop Park, removal of <br /> <br />fencing adjacent to the Summerset Subdivision (Sheet 5), resident notification and the design and <br /> <br />construction time frame for Phase 1. Mr. Aramendia clarified that the planter shown on the southwest <br /> <br />corner of Crystal Bowl Circle (Sheet C-09) is actually a large cabbage palm. Mr. Aramendia suggested <br /> <br />adding a trash receptacle to the existing Zinnia Bike Trail and adding two cypress trees at the edge of the <br /> <br />retention pond at the Marigold Trail Head (Sheet HS-01). <br /> <br />Mr. Parkhurst asked if there was anyone in the audience who wished to speak in favor of, or in <br /> <br />opposition to, the request. Ms, Lucille Weinroth, 2685 Queen Mary Place, Maitland, Florida came forward, <br /> <br />Ms, Weinroth expressed a concern with liability if a person was injured on the bike path. Mr. Fortini, <br /> <br />Administrative Services Director, explained that the City may be held liable based on the circumstances of <br /> <br />the accident and injury. He said if the bike path is not maintained within the standard requirements the City <br /> <br />could be liable. Mr. Fortini said the addition of the bike trail would not increase the City's insurance <br /> <br />premium. <br /> <br />A general discussion ensued regarding the installation of signage stating the use of the bike trail is <br /> <br />at the public's own risk. Mr. Fortini stated that the use of that type of signage gives an admission of risk; <br /> <br />therefore, that type of signage is not used within our park. He said it would also be difficult to post signs on <br /> <br />the bike trail due to the multiple access points. <br />
