CITY OF CASSELBERRY CODE ENFORCEMENT BOARD Mlrr:TING NOVEMBER 13, 2008, page 4 CE-08-02463 145 Overbrook Drive Martinez, Jeanette & Cruz, Rafael J /owners overgrown property 70-2 Alves Armour made a motion to fmd that Respondents in CEB Case #08-02463 did not comply with the Code Enforcement Board's Order of 10/15/2008 by the date specified in that Order and that the fine of $2?0.00 will be imposed for 6 days of non-compliance and also for mowing and administrative costs. The violation has since complied on 10/29/2008 and therefore a fine in the amount of $270.00 is hereby imposed. Robert C. Flint seconded the motion. The motion passed unanimously. Per Florida statutes the City now had the authority to seek collection measures including foreclosure action to recover the cost of the fine. The City recommends that the Board pursue these actions. Richard L. Henderson asked if Mr. Casselberry wished to speak. CES Brown stated this situation has gone the full gamut, with the exception of an appeal in circuit court. The City's position was that new testimony would inappropriate. The City was only asking to seek foreclosure. Mr. Henderson stated be he understood and did not disagree, however council recommended the Board give a few moments to speak. Kenneth Beane, 2601 Wells Ave, Casselberry. . Henderson asked if Mr. Beane spoke for r. Casselberry at the City Council meeting. Mr. Beane stated yes.
