Conditional use request <br />alcohol sales for a barllounge in a CG zoning district. <br /> <br />Mr. Charles Senzee, Planner, reviewed the information provided in his memorandum dated <br /> <br /> <br />2009, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br /> <br />Department). Mr. Senzee requested the Planning and Zoning Commission add the following to the conditions of <br /> <br />approval: "The applicant shall provide irrigation for all new landscape material in a manner consistent with the <br /> <br />Unified Land Development Regulations". He said this condition was not included in the original conditions of <br /> <br />approval in the January 22, 2009 staff report. <br /> <br />Mr. Senzee said staff finds that the design of the proposed use is compatible with the surrounding <br /> <br />uses. He said if the Planning and Zoning Commission chooses to approve <br /> <br /> <br />to allow a bar/lounge at 1 <br /> <br />State Road 436, the motion should be based on the staff report dated January 23, 2009, the site drawing (Exhibit E), <br /> <br />the Planning and Zoning Commission's findings of fact, the conditions of approval as stated in the staff report and an <br /> <br />additional condition of approval requiring that all landscape material be irrigated according to City regulations. Mr. <br /> <br />Senzee requested that the conditions of approval be renumbered to change the current condition no. 16 to no. 17 <br /> <br />and the additional condition of approval would be numbered 16. <br /> <br />A brief discussion ensued regarding changing the operating hours. Mr. Henson asked the applicant to come <br /> <br />forward. Mr. Larry Powalisz, 4583 Whimbrel Place, Winter Park, Florida came forward. Mr. Powalisz requested <br /> <br />modifying the hours of operation that were requested in the staff report. A brief discussion ensued regarding <br /> <br />hours of operation. <br /> <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br /> <br />the request. No one came forward. <br /> <br />After a brief discussion, Mr. Henson asked for a motion to address CU 09-02. Mr. Parkhurst recommended <br /> <br />approval of CU 09-02, changing condition no. 8 to read: "The hours of operation shall be 7 days a week from 11 <br /> <br />a.m. to 2:00 a.m:, the addition of condition no. 16 stating: "The applicant shall provide irrigation for all landscaping <br /> <br />materials in a matter consistent with the City's Unified Land Development Regulations", renumbering the conditions <br />
