He said <br /> <br />he wants the site to be in compliance. <br /> <br />Mr. Don Brown, attorney, 533 Versailles Drive, Maitland, Florida came forward. Mr. Brown said that <br /> <br />indicated in the staff report that the subject business will have a detrimental impact on the neighboring businesses if <br /> <br />approved and staff also states that the neighboring businesses are car lots and a tattoo parlor. Mr. Brown <br /> <br />was not sure what negative impact another car lot would have on these neighboring businesses. <br /> <br />Mr. Brown said it seems that the regulation requires a minimum number of parking spaces for a commercial <br /> <br />business and felt that it would be more appropriate for the owner of the property to determine how the parking <br /> <br />are utilized as opposed to a governmental entity. <br /> <br />Mr. Mogul stated that there was a representative from the business present to answer any questions. <br /> <br />Commission had no questions for the business' representative. <br /> <br />Mr. Henson asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br /> <br />the request No one came forward. <br /> <br />Mr. Senzee explained that the City Code requires this business to have ten parking spaces for employees <br /> <br />and customer parking. Mr. Senzee read a portion of the City Code regarding storage of inventory vehicles for an <br /> <br />automobile sales facility stating vehicles are not allowed to park in the required customer and employee parking. A <br /> <br />brief discussion ensued regarding the parking requirements for the site and parking of vehicles for automotive <br /> <br />Mr. Brown stated that he disagrees with the rendition of the interpretation of the City Code. <br /> <br />Mr. Mogul explained that the employees drive the inventory vehicles to the site and there are no employee <br /> <br />vehicles parked on the site. <br /> <br />After a brief discussion, Mr. Henson asked for a motion to address CU 09-01. Mr. Parkhurst recommended <br /> <br />denial of CU 09-01 for Auto Specialists at 1786 State Road 436, Winter Park, Florida. Mr. Hale seconded the motion. <br /> <br />The motion passed unanimously by voice vote. <br />
