<br />Planning & Zoning Commissionl <br />Local Planning Agency <br />January 28. 2009 <br />Page 2 <br /> <br />approve CU 09-01 to allow an automotive dealership at 1786 State Road 436, the motion should be based on <br /> <br />staff report dated January 22, 2009, the site drawing (Exhibit C), the Planning and <br /> <br />Commission's findings of <br /> <br />fact, and the conditions outlined in the staff report which were: <br /> <br />1. The conditional use shall be limited to the existing 3,301 square foot structure. No expansion of <br />structure or site may occur without additional Planning and Zoning approval. <br />2. All signage requires permit approval and must comply with all city requirements. A permit application <br />shall be submitted to the Casselberry Building Division for all siqnaqe on the property. Any signage not <br />approved during this process shall be immediately removed. Temporary, attention getting devices <br />not be used on-site, including on individual vehicles. <br />3. The site landscaping shall be restored to match the approved 1996 site plan (Exhibit B). The applicant <br />shall submit an acceptable landscape plan to the City's Community Development Department. The site <br />shall pass a full landscape inspection within 60 days of conditional use approval. <br />4. The parking lot shall be re-striped to match the approved 1996 site plan (Exhibit B). This re-striping <br />process shall meet City standards, including the use of thermoplastic material, completed within <br />days of conditional use approval, and conducted under the supervision of the Casselberry Public <br />Department. <br />5. The site shall meet the City's current exterior lighting regulations. A photometric inspection shall be <br />conducted by Community Development staff within two weeks of conditional use approval. Any lighting <br />deemed unacceptable by staff shall be removed and/or replaced. <br />6. The on-site automobile inventory is limited to nine (9) vehicles. <br />7. Conditional use approval is for the sale of passenger vehicles only. No commercial vehicles or <br />equipment may be sold from the site. <br />8. All inventory vehicles shall be placed within the limits of the approved parking spaces. <br />9. The area approved for conditional use shall be comprised of a single business location. <br />10. The existing wash/detail area will only be used for vehicle washing/detailing and will not be used <br />other type of vehicular servicing including but not limited to oil and battery changes, and tune-ups. <br />11. If necessary, the applicant shall apply for and receive a wastewater discharge permit from the <br />Public Works Department. <br />12. No outdoor activities, seating, or events are permitted. <br />13. Hours of operation shall be Monday through Saturday, 9:00am - 5:00pm. <br />14. The business shall remain in complete compliance with all City, County and State requirements. <br />15. There shall be no outside display or storage of goods, materials, services. The only exception to <br />will be the nine (9) inventory vehicles allowed on site. <br />16. The conditional use shall expire if the use is discontinued for more than 90 days. <br />17. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />and void. <br /> <br />After a brief discussion, Mr. Henson asked the applicant to come forward. Mr. Max Mogul, property owner, <br /> <br />1786 State Road 436, Winter Park, Florida came forward. Mr. Mogul said that he has developed and owns several <br /> <br />properties in Casselberry. Mr. Mogul said there are several automobile sales businesses along State Road 436 <br /> <br />he owns the adjacent parcel which is an auto repair shop.
