<br />Planning & Zoning Commissionl <br />Local Planning Agency <br />January 14,2009 <br />Page 2 <br /> <br />dated October 16, 2008, staff memo dated January 8, 2009, and the following revised conditions of approval as <br /> <br />outlined in the staff memo which were: <br /> <br />1. The conditional use shall be limited to the Green Parrot establishment bar located at 280 SR 436 within <br />Units 29, 30, and 31, <br />2. The site must comply with all the conditions of the Findings of Fact and Order from CU 00 05 <br />(Attached) <br />3. The conditional use activity shall occur only so long as the use is operated with a 4-COP or <br />license in force at all times. <br />4. All sales and consumption of alcoholic beverages shall be on-site and indoors. <br />5. Package sales of alcoholic beverages for off-site consumption are prohibited. <br />6. Hours of operation shall be Monday through Saturday, 11 :00am-2:00am, and Sunday, 12:30 <br />2:00am. <br />7. The business shall remain in complete compliance with all City, County and State requirements. <br />8. There shall be no outside display or storage of goods, materials, or vehicles. <br />9. The conditional use shall commence within 90 days of the approval. <br />10. The conditional use shall expire if the use is discontinued for more than days. <br />11. All signage requires additional permit approval and must comply with all city requirements. <br />12. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br /> <br /> <br />Mr. Buchanan asked the applicant to come forward. Mr. John Miranda, 280 East State Road <br /> <br />Casselberry, Florida came forward. In response to the Commission's question, Mr. Miranda said he read and <br /> <br />understands the staff report. There were no other questions for the applicant. <br /> <br />Mr. Buchanan asked if there was anyone in the audience who wished to speak in favor of, or in opposition <br /> <br />to, the request. No one came forward. <br /> <br />A general discussion ensued regarding bars located in strip centers, distance separation requirements <br /> <br />alcohol sales, the conditions of approval and the sunset date included in the Findings of Fact and Order for CU <br /> <br />05. Ms. Smith reviewed the current distance separation requirements. <br /> <br />Mr. Buchanan asked for a motion to address CU 08-11. Mr. Henson recommended approval of CU <br /> <br />based on the staff memo dated January 8, 2009 from Mr. Senzee to the Planning and Zoning Commission, adding <br /> <br />back in condition no. 2 and revising that portion of the findings of fact that relate to 75% of gross revenue being <br /> <br />derived from foods sales which is item no. 6 under the findings of fact and item no. 8 under the Order. <br /> <br />The motion failed due to the lack of a second. <br />
