Mr. Henson <br /> <br />a <br /> <br />motion to approve CU 08-11 based on the staff memo dated January 8, <br /> <br />from <br /> <br /> <br />to the Planning <br /> <br />Zoning Commission and with the additional findings of fact to be added to the conditions of approval outlined in the <br /> <br />staff report: <br /> <br />1. Conditional use is limited to Units 30, 31 as provided in Exhibit A. further expansion <br />occur without further conditional use approval. <br />2. The area approved for conditional use shall be comprised of a single business location. <br />3. This conditional use approval shall null and void if the conditional use activity is discontinued for a <br />period of 60 consecutive days for any reason. <br />4, The conditional use activity shall occur only so long as the use is operated a 4COP or <br />state license. If this license or equivalent is not active or valid at all times this conditional use approval <br />shall become null and void. <br />5, The hours of operation shall be Monday through Saturday, 11 :00 to 2:00 and Sunday 1 to <br />a.m. <br />6, If there is a transfer of ownership, ground lease, or state liquor license for the business new <br />owner/lessee or liquor license holder shall seek approval from the Planning and Zoning <br />which approval shall not be unreasonably withheld. <br />7. This conditional use approval CU 08-'11 shall expire and become null and void for all purposes on <br />January 31,2015. <br />8. Workshop to <br />develop zoning district criteria consistent with the new MTMU future land use category. <br /> <br />A brief discussion ensued regarding postponing this item until the new members are seated at the February <br /> <br />11, 2009 Planning and Zoning Commission meeting.
