The lien for the above case is for <br />$1,600.00. On 12/08/2005 there was a first request for reduction/waiver, the request was denied by the Board. On <br />11113/2008 the Board heard a request by the City to pursue foreclosure action, this was approved, and the matter <br />was turned over to the City Attorney for foreclosure action. The City's position is that the fine was reasonable, the <br />parties involved were property noticed, and the City asked that his reduction not be approved. <br /> <br />John Casselberry, 700 S. Lost Lake Lane, Casselberry, gave testimony. <br /> <br />Discussion. <br /> <br />Kathleen A. Hale made a motion in CEB Case # 05-01783 that the reduction request be denied. <br /> <br />Robert C. Flint seconded the motion. <br /> <br />The motion passed unanimously. <br /> <br />CE-07 -00087 535 Queens Mirror Cir Casselberry/owner Minimum maintenance 1-4.1 <br />Which adopts 101.6 SHC 1994 ED <br />Ketron Brown, Code Enforcement Supervisor read the history for the above case. 02/08/2007 was the date of first <br />hearing, a date certain of 03/21/2007 was set by the CEB for compliance, or a fine of $250.00 per day <br />would be imposed. On 04/12/2007 there was a subsequent hearing, the fine of $250.00 per day was imposed, a <br />follow-up inspection was not conducted due to Mr. Casselberry not requesting one and there being a "no <br />trespassing sign on the property". On 07/0212007 there was a follow-up inspection, after requested by Mr. <br />Casselberry, found to be non-compliant by Fire Marshal, Tim Ippolito. <br />On 07/06/2007 there was a second follow-up inspection by Mr. Ippolito, found in compliance. The fine ran for 107 <br />days for a total of $26,750.00.0n 08/0912007 there was a request reduction/waiver of lien, this request was <br />denied by the CEB. On 10/2212007 the City Commission reviewed the matter and concurred Code Enforcement <br />Board to deny the reduction request. On 11/1312008 the case was sent to the CEB for a foreclosure decision. The <br />CEB did recommend this case be referred to the City Attorney and is currently being sought for collection by the <br />City Attorney. It is the City's position that the violation did occur, proper notices were provided to the parties <br />involved, the property owner is required by statute. The City would not recommend reduction. <br /> <br />Debra Babb-Nutcher swore in Mr. Casselberry. <br /> <br />John N. Casselberry, 700 S Lost Lake Ln gave testimony. Mr. Casselberry felt that there was violation of the <br />Sunshine Law when this case was first heard by the Board. He then referenced a letter from 11/05/2008. <br /> <br />Ms. Nutcher advised the letter Mr. Casselberry was speaking of was reviewed by the attorney's office, the <br />allegations were looked at and they did not think they were relevant and he did not even bring it up at his last <br />request. <br /> <br />Discussion. <br /> <br />Ms. Nutcher stated she felt there was no violation to the Sunshine Law. <br /> <br />Discussion. <br />
