<br />CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />FEBRUARY 12,2009, page 4 <br /> <br />REQUESTS FOR REDUCTIONIW AIVER OF LIEN <br /> <br />CE-04-o2074 <br /> <br />1241lancelot WavEngel/owner <br /> <br />Trash & debris 70-2 tC) <br /> <br />Ketron Brown, Code Enforcement Supervisor read the case history for the above case. <br /> <br />Scott Engle 1241 Lancelot Way, Casselberry, FL gave testimony. the time of this case he was also working on <br />trying to comply on another case. This was not so much for trash as it was for trees down in the yard. A tree from <br />the neighbor's yard fell in the street and when someone moved the tree they put a large portion of the tree in Mr. <br />Engle's yard. Mr. Engle stated there has been casual conversations about this violation and the other two violations <br />that were going on at the same time, she was told ahead of time that he would have this done in a couple of weeks. <br />There was never any formal conversation after that telling Ms. Lee he had complied, she was constantly checking <br />on the progress of the other projects so he thought she knew he was in compliance long before May. <br /> <br />Alvera Armour, Vice-Chairperson asked what date he thought he was in compliance. <br /> <br />Mr. Engle stated at the latest was by Super Bowl Sunday, when he took the wood to his friend's house. <br /> <br />Mr. Brown stated there were not any digital photos, but there were some file photos that could be passed around. <br />This was basically a large tree that had come from a neighbor's property. The small limbs had been removed and <br />just the large trunk sections on the tree that had obviously been cut, there were attempts to get it cleaned up. This <br />was an a result of storm damage. Mr. Brown advised that when he took over in Code Enforcement he made contact <br />with individuals that have outstanding fines or liens on their property. Mr. Engle contacted us immediately and it <br />trying to resolve this, and there have been no other Code complaints there. Mr. Brown stated he thought due <br />consideration was appropriate. <br /> <br />Kathleen A. Hale asked staff what kind of administrative fees are involved. <br /> <br />Mr. Brown stated the only fees would have been $60.00 to record the lien. <br /> <br />Robert C. Flint asked Mr. Engle when he was notified of this fine. <br /> <br />Mr. Engle stated May of 2005, and then for four years heard nothing. Mr. Engle that received a letter that the City <br />was trying to collect on the debt on 10/27/2008. <br /> <br />Discussion. <br /> <br />Mr. Brown recommended due consideration, this was an act of nature. There is evidence that there were efforts <br />made to correct the violation. <br /> <br />Robert C. Flint made a motion that the Board recommend to the City Commission that the lien will be <br />reduced in CEB Case #04-02074 from $6,650.00 to $100.00, TO BE PAID WITHIN 60 DAYS FROM THE <br />DATE OF THE COMMISSION'S ORDER, OR THE FINE REVERTS TO THE ORIGINAL FINE <br />AMOUNT. The reason for the reduction is mitigating circumstances related to the administrative actions of <br />the City. <br /> <br />Kathleen A. Hale seconded the motion. <br /> <br />The motion passed unanimously. <br />
