<br />CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />JANUARY 08, 2009, page 6 <br /> <br />NEW CASES <br /> <br />CE-08-03626 1500 Carlisle Drive/ Hoffman <br /> <br />Commercial vehicle parkine: 3-10.9 <br /> <br />Marlene Broman, Code Enforcement Officer gave testimony for the above case. This case was first observed on <br />12/0612008 during a neighborhood inspection, and Notice was sent. On 12/16/2008 Affidavit of Notice of Code <br />Violation and Request for Hearing was sent. This commercial vehicle is a tow truck; City Ordinance stated tow <br />trucks are not allowed in a residential neighborhood. The property owner informed CEO Broman that he works for <br />a tow company and they are emergency response for other police agencies. CEO Broman suggested to go forth to <br />Code Board and present this case. The property owner and business owner were present at the 01108/2009 Code <br />Board hearing to request a special variance pending their circumstances. of 01/08/2009 the violation still exists. <br />The City was requesting a Finding of Fact with no fine imposed. <br /> <br />Robert C. Flint, Member stated it was his understanding that the City supported this, since no fine should be <br />imposed. <br /> <br />CEO Broman stated no fine, due to the activity, they respond for other police agencies as a tow company for police <br />vehicle and non-police vehicles. They thought as a special response unit they were exempt from this rule, they did <br />not realize it applied to them. A Finding of Fact was requested and the City wanted the Board to deliver a variance. <br /> <br />Debra Babb-Nutcher, Assistant City Attorney, stated the Board is not that type of entity. <br /> <br />Ketron Brown, Code Enforcement Supervisor stated if the violation continues the City would be looking for a fine <br />to be imposed, however they were not seeking a fine at the 01/08/2009 hearing. <br /> <br />Ms. Nutcher stated were they not just asking the Board to make a Finding of whether they are in violation or not <br />and give them x number of days to comply and if they don't comply then a fine is imposed. <br /> <br />CES Brown stated yes. <br /> <br />Mr. Flint stated the Board does not issue variances; they are the authority of the City Commission. <br /> <br />CEO Broman stated they were there to plead their case and she was there to present her findings. <br /> <br />Alvera Armour, Vice Chairperson stated they have had cases like this <br />and it does stand. <br /> <br />past, but the ordinance is the ordinance <br /> <br />Dean Pritchett, 110 Willow Tree Lane, Longwood, FL gave testimony. <br /> <br />Discussion. <br /> <br />Paul L. McKernan made a motion to imd Respondent in CEB Case #CE-08-03626 in violation of City Code, <br />Section 3-10.9, and that Respondent correct the violation before 1:00 p.m. 01129/2009. Another hearing will <br />be held before this Board on 02/12/2009 to determine compliance by the aforestated date, and, if there is no <br />compliance by the aforestated date, a ime in the amount of $25.00 per day will be imposed for each and every <br />day the violation continues past the aforestated date. The Respondent is further ordered to contact the Code <br />
