<br />CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />JANUARY 08, 2009, page 5 <br /> <br />John Winkleblack, 15515 Trousdale St, Clermont FL, gave testimony. Mr. Winkleblack stated they were asking for <br />a reduction of the fine to zero. The property is now in compliance and they have gone ahead and taken care of the <br />building behind, they were out of compliance on that and have painted the building and the roof. Everything is <br />100% in compliance. <br /> <br />Alvera Armour, Vice-Chairperson stated she wondered what staff recommended. <br /> <br />Michele Lawrence, Code Enforcement Officer stated that the City would consider their reduction of lien, however <br />to totally eliminate it would not be cost effective. She could not specifically tell what the costs are at this time on <br />the filing of the lien; Brenda might know what costs were involved specifically for that and the time it has taken us. <br /> <br />Ms. Armour stated it has been a long time. <br /> <br />Brenda Jones, Recording Secretary stated she did not know how many hours were put into it by different officers. <br /> <br />Ms. Armour asked who would have that information. <br /> <br />Ms. Jones stated the Officers handling the case would know better than she would. <br /> <br />Debra Babb-Nutcher advised that it was in the Boards discression. <br /> <br />Kathleen A. Hale, Member stated 5 or 6 months is nothing compared to what some places we are dealing with, and <br />they are thrilled that this gentleman continued to show up, which is a point in their favor. We do not get that very <br />often, the Board knows he tried hard and was dealing with management and the economy. <br /> <br />Mr. Brown stated the City is sympathetic to the situation that existed, however the City also did meet all of its <br />obligations for Notice and made every effort to try to get compliance. Given the current economic situation of the <br />whole country and the long standing of this particular company in the City, Mr. Brown asked that some <br />consideration be given. Once the new management came in, he has been at every meeting we have asked him to be <br />at, made every effort to clean it up, and actually gone beyond what we would expect in improving that property, <br />those are factors that should be considered. A reasonable reduction would be beneficial to the City and to the <br />company as well. <br /> <br />Robert C. Flint stated the Board had come to a consciences that 25% would be adequate amount because it was a <br />public site. <br /> <br />Robert C. Flint made a motion to recommend to the City Commission that the lien be reduced in CEB Case <br /># 08-00341 from $12,300.00 to $3,000.00 to be paid 60 days from the date of the commissions order, or the <br />ime/lien reverts back to the original ime/lien amount. The reason for the reduction is mitigating <br />circumstances and support of the present management of the organization. <br /> <br />Paul L. McKernan seconded the motion. <br /> <br />The motion passed unanimously. <br />
